The government, all the governments, are not telling us the truth about the extent of the radiation... they are not telling the truth about the gravity of the accident in Japan, about the fuel rods blown to smithereens all around the nuclear power plant... where is GE, where is the International Atomic Energy Agency? Nobody knows what to do, they're just hoping it's going to go away, there's no mobilization of all nations, where is the UN? The folly, it's flabbergasting, and yet I don't think anyone reading this blog would have expected anything less in case such an accident would happen, and now it has... and nobody is listening. Expect maybe now the spiritual leaders of this world.

On Friday, Deepak Chopra has opened his doors, there is going to be an outcry from all those who care and understand about the fragility of life on Earth, this can't go on, none of it can, or there won't be anything left to save. Who benefits from all this? Are they really human? Haven't they seen the Earth from space, don't they know it's not limitless, it stands alone, with an atmosphere so thin, it could vaporize any second transforming our planet into Mars. And maybe that's our fate, but I still want to hope not, sorry for the soap box.

I know I worked very hard, you know here how hard I have worked, to transform Indian Point from just another aging nuclear power plant into a symbol for the entire movement, which when I entered it again, back in 2006, frankly, was quiet as a mouse, barely heard in the halls of Congress.

I've reached the point where I don't know what to do next, I'm lost, sad, confused, angry, tired, sick... but I know where I planted my seeds and with a little luck, they will grow into ducks lined in a row, and topple this empire of stupidity and greed.

I know you probably all think Trump is a fool, but I don't. He's been an exceptional businessman his entire life. Those who know him personally give him a sense of humor and a heart. He's a New Yorker. He now owns and runs a direct marketing network. If we can get Trump on the record wanting to shut down Indian Point, this could be a major victory for our side, regardless of whether or not you would ever want him for president. We need people like him, influential and powerful men and women in the world of science, business and politics, to rise up and pronounce their outrage at the way General Electric has built and run their nuclear reactors in Japan, which are now threatening the genome of all living things.

I'm pissed, because I bent over backwards to accommodate so many complacent fools. And now I can almost feel the radiation in my bones, which is worse than any atmospheric nuclear bomb test. We're killing this planet, numbed our senses to live resigned to be ruled by idiots. How many more nuclear disasters do we need? Don't let the media bury this, talk to the vast and wide community of independent small farms that have erupted around city centers. Don't discount the Native American community.

We can reclaim our future. But we need young people to understand, to stop believing the lies about healthy doses, to know that these radioactive isotopes don't exist in nature, that we made them, just like plastics. Biological systems don't know how to break them down.

I hope the anti-nuclear movement re-awakens, and joins forces with the green movement. I hope the green movement gets it now, and stops listening to misguided climate change alarmists like Patrick Moore, James Lovelock or Steward Brand.

A wave of anger is growing from Japan, it's loud, it's clear, they blame us, they blame America, they blame GE and our war machine, for the horrendous suffering they are experiencing again. It's near certainty now that Tokyo will have to be evacuated, that it will become the first ghost metropolis of the modern age. All so they could light up their avenues like Christmas trees.

I grew up loving Astro Boy... he was my cartoon hero as a child, this little black and white cartoon character which I couldn't wait to see on TV every afternoon while I vacationed here from France visiting my grandmother. But there's no real Astro Boy... at least not yet, maybe not for a long, long time. Maybe never if we don't find a way to stop this, rise out of all the technicalities, needled to death by minutia, and grow a single minded political action that gets the job done, and done quickly.

THE NUCLEAR REGULATORY COMMISSION REQUIRES EVACUATION ONLY OUT TO TEN MILES IN CASE OF A NUCLEAR ACCIDENT EVEN THOUGH NYC IS 24 MILES DOWNWIND. SINCE IT IS IMPOSSIBLE TO EVACUATE TEN MILLION PEOPLE, IT IS IMPERATIVE THAT INDIAN POINT BE IMMEDIATELY SHUT DOWN PERMANENTLY.

We don't need nuclear energy. During the heat wave of 2006, all nuclear power went off in the state and our electricity was still maintained. Only an average of 4-6% of the state's power comes from Indian Point. What we really need is an all out investment in ENERGY EFFICIENCY AND clean, renewable energy -- solar and wind, and a phase out of dirty and dangerous energy like coal, oil, gas and nuclear.

Indian Point is a disaster waiting to happen. Shut Down Indian Point Now! (SDIPN!) is a new group of activists that have come together for the express purpose of preventing another Fukushima in New York.

We are NOW demanding that Indian Point be shut down for the simple reason that nuclear power is inherently unsafe and until Indian Point is shut down, and replaced by renewable sources of energy, we shall not rest!

It's the ICRP, dedicated member of the international scientific nuclear industry lobby which likes to tell governments what standard doses of radiation they should apply to their people by law. The only way you could license nuclear power plants and not have murder is if you could guarantee perfect containment. But they admit that they're not going to contain it perfectly. They allow workers to get irradiated, and they have an allowable dose for the population. So in essence I can figure out from their allowable amounts how many they are willing to kill per year."

Now in the case of the ICRP, the containment is out of control, plutonium, cesium 137, Iodine 131 reaching levels approaching Chernobyl--and now they want to raise the allowable dose for the population to 20 millisieverts per hour. If Goffman were alive today, I think he would be screaming murder.

How sadly tragic that many of the things warned about in this blog have come to fruition as citizens of Japan sit huddled together, alone and scared as they are ordered "Sheltered in Place" as the cancers from the radioactive fallout creeps into their bodies...can we all sing the nuclear industry lie, "There is no immediate danger"...fuck you Indian Point, NEI and NRC...there is danger, and hundreds of thousands of Japanese citizens are already destined to endure horrid cancers, many of them leading to deaths the nuclear industry will deny.

Indian Point needs to close...how many of you know that all three back up diesel generators are housed in the same building on the site? One fire, one flood, and our community is in the same boat Japan now finds itself in, and trust me, the situation there is far worse than the FACE SAVING Japanese officials are letting us know.

This blog was and is my domain, a project breathed into life for a purpose...it is time that I take it back, clean up the garbage from it's bones that does not belong, and refocus it back to it's original intent...a weapon with which to spread the truth about nuclear energy, do wake up the masses.

Cuomo Orders Safety Review Of Indian Point Nuclear Plant

BUCHANAN, N.Y. (CBSNewYork) – Governor Andrew Cuomo has ordered a complete safety review of Westchester County’s Indian Point nuclear plant after startling new information was revealed by the Nuclear Regulatory Commission.

The NRC reportedly ranked Indian Point as the reactor with the highest risk of earthquake damage in the United States, even higher than the twin reactors in California’s quake zone, reports CBS 2′s Marcia Kramer.

“The Indian Point power plant is the most susceptible to earthquake because reactor number three is on a fault,” Gov. Cuomo said. “Frankly, that was surprising to me. One normally doesn’t think of earthquakes and New York in the same breath.”

Experts say Indian Point is about one mile from the intersection of two faults, and that has the governor concerned.

The plant is just 24 miles from New York City, and according to the NRC, it’s the plant with the highest possibility of earthquake damage.

Cuomo wasted no time in ordering an immediate safety review.

“I’ve had concern about Indian Point for a long time. As attorney general, I did a lot of work on Indian Point,” he said. “My position was that it shouldn’t be relicensed. My position was that it should be closed. I understand the power and the benefit; I also understand the risk, and this plant – in this proximity to New York City – was never a good risk.”

The folks who run Indian Point, however, say they’re not worried about a Japan-like meltdown there.

“I say only if a tsunami could make its way…up New York Harbor and the Hudson River, somehow avoid New York City, and drench our plant,” Jim Streets, director of communications at Entergy Nuclear Northeast, said. “It just doesn’t seem very realistic to me.”

Indian Point’s licenses are up for review in 2013 and 2015. Cuomo’s involvement in the case, and the findings of his safety review, could have an effect on those licenses.

France: The latest "Discovery" of a disturbing "anomaly" in a series of 34 reactors

The news remained discreetly buried in the depths of the site of the French Nuclear Safety Authority (ASN): Following recent studies, EDF has just "discovered" a disturbing "anomaly" standard on 34 of its reactors. In all reactors of 900 MW in case of major leakage from the primary circuit, the water injection safety circuit may be unable to prevent the meltdown of the reactor core.

The Nuclear Safety Authority (ASN) warns: "In an accident situation, for breach of certain sizes of primary pressure, the injection from the high pressure safety system may not be sufficient enough to cool the reactor core" (i) ..

The water injection security system is the only device that allows to delay a nuclear meltdown if there is a major leakage of primary circuit water. Its role is to inject massive quantities of boron water (ii) in this circuit to suppress the nuclear reaction and cool the core.

So EDF has discovered this while the first series of 900 MW reactors have been running for over 30 years (iii), it is unable to assess whether the injected water through the system is uniformly distributed in the three loops of the primary circuit of the reactor; the ASN has admitted ,"it might not allow sufficient cooling of the reactor core" (iv).EDF has let 34 nuclear reactors run for a quarter of a century before to ensure the effectiveness of this primary prevention system against nuclear meltdown.

Why has this discovery occurred so late? It is extremely disturbing that a problem of this magnitude has been ignored for so long by EDF ...

The plants concerned are: Blaye (Gironde), Bugey (Ain), Chinon (Indre-et-Loire) Cruas (Ardèche), Dampierre (Loiret), Fessenheim (Haut-Rhin), Gravelines (Nord), Saint- Laurent des Eaux (Loir-et-Cher), Tricastin (Drôme). Or all of the thirty four 900 MW nuclear reactors, some of which have already reached 30 years of operation. EDF has put all its eggs in one basket, multiplying the risks as they go along....

Under the precautionary principle, the Network "Sortir du nucléaire" demands the closure of the reactors concerned

An accident caused by these "anomalies" would have catastrophic consequences. In a context where security concerns are increasing in recent years (v), this possibility must always be taken into account. Especially considering that 21 reactors run on MOX fuel containing plutonium.

More than ever, the discovery of these failures shows vividly the need for a political energy transition as quickly as possible, to finally get out of the French nuclear risk imposed on the population for decades.In light of these security deficiencies, the Network "Sortir du nucléaire" has requested that the ASN plays its role, in requiring EDF, under the precautionary principle (vi), the closure without delay of the 34 reactors concerned.

Green Lighting Book Soon Off The Press

In a few days our long awaited Sword of Damocles will be off the press and in the hands of anti-nuclear warriors all over the land.

Sadly the beautiful cover image of Betcee May shot by photographer Courtney Dailey was rejected by the editors at McGraw-Hill because the Philips EnduraLED Betcee held was shot too wide, and they couldn't tell what kind of bulb it was.

There was no opportunity or time to reshoot, so instead McGraw-Hill went with a close-up of the Pharox, who are big supporters of Global Green USA and design some of the best LED greenhouse lighting in the world.

A lot of hearts were broken, tempers flared, dreams shattered, it would have been amazing to feature the Rock The Reactors muse on the cover of a book so many worked so hard to produce, a book which carries such a strong message, that for the retrofit cost of LEDs, you can easily make up all the replacement power necessary to decommission old and dirty nuclear power plants.

Robert Van Winkle Jr.'s Lighting Every Dimension!

Robert Van Winkle Jr. stopped by the Aquarium, home base for Rock The Reactors, to demonstrate LED replacement tubes for T8 fluorescent fixtures. By law, in Connecticut, for buildings to stay up to code, all T8 bulbs must now be replaced by more efficient T5. But there's another way, a better way.

By switching from fluorescent to LEDs, you save half the amount of energy to run your entire lights. Instead of replacing the old ballast, you simply disconnect it and rewire the fixture to run current directly to the LED tubes.

LEDs will last much longer than fluorescents, for the same amount of lumens, guaranteed up to 50.000 hours, and three years free replacement in case one burns out, which is rare but sometimes happens when they are new.

You also have the option to choose the color temperature you like for the room; cool white, warm white, anything in between. The company will tune the tubes to shine the shade you want them to be.

Replacement tubes are still pricey, but they pay for themselves in energy savings, in quality of lighting, maintance costs, and bragging rights.

At the Aquarium, we plan to retrofit all the old fluorescent tubes with LED replacements. We are working with our landlord to make it happen.

No state provides rebates for LED lights yet, which is a crying shame, because there is no better, quicker way to reduce electrical consumption, conserve energy and go green!

Instead there are private loan companies like GREENandSAVE and their spokesperson Project Green Search finalist and NASCAR driver Leilani Munter, who will help home and business owners cushion the cost of LED retrofits.

I'm looking for fresh ideas for a lot of things, and inspiration doesn't come as easily as it used to. We're faced with a lot of dead ends, complex green strategies come to nothing confronted with the immensity of the financial resources at the disposal of the planet thrashers. It's getting harder and harder to stay one step ahead of them, even with social networks.

The Blue Meanies function in their own insulated power universe the best of intentions can't penetrate. Our only weapon is fashion, and guilt... people quit their jobs because they start feeling queasy... that's dangerous in a crap economy, with no golden parachute. In the 60's, you turned on, tuned in and dropped out. Now you try, in vain, to change the world from the inside out.

So 30 years after Earth Day, we're in a great sense, practically back where we started from, not technologically, but politically. The same reactionary mentality rules Washington and the Fortune 500, no better exemplified than by Obama showing his true pro-nuclear colors.

Wake up Green America, it's time to get back to the roots of where the environmental movement began, and that's how absurd nuclear power really is. With the collapse of that industry, will come liberation of all other energy sources, like a ball and chain finally off our feet!

Each year it gets worse, as almost every reactor in the world leaks, it just doesn't stop, does it? You know what happens when the faucet drips? Eventually the sink gets full... climate change will be the least of our worries as the remnants of humanity have to live in radiation shelters!

What I don't get, is how much of a global preoccupation this all was back in the 60's and 70's and how now, everyone has since become so complacent. It's almost as if the same psychological phenomena that takes place in reactor hosting communities, has spread to the entire population at large. The whole planet lives in a state of denial about the deadly poisons we're unleashing for the sake of hanging on to the last threads of the post-industrial civilization.

We're all about to become bedouins!

And the worse part, is that after 30 years, we have developed the alternative means to produce electricity, cheaper, better, cleaner, faster... and yet they STILL want to shuv more nukes down our throats.

These people are monsters and criminals, and much like Jon Stewart demonstrated when he spliced Bush and Obama speeches together, they both say exactly the same words, the same phrases, all that has changed is the tone in their voices.

Who do we have to thank for this... other than the Rockefeller Brothers Fund, who for some weird, strange reason, never minded living in a palacial estate just five miles south from the most dangerous nuclear power plant on earth?

Go figure, we must all be stupid monkeys!

Entergy Is Broke! Long Live Duron!

Entergy is broke, all the tell tale signs are there... The workers at Indian Point are threatening to strike... Entergy is threatening to shut down Vermont Yankee if the Vermont legislature doesn't allow them to operate without sufficient decommissioning funds, because Entergy lost the nest egg playing the market. In turn the state of Vermont is threatening not to issue Entergy a new license because Entergy lied about the extent of a tritium leak which has spread to the Brattleboro water supply... and while all this is going on... Entergy decides to sue the Army Corps of Engineers for $68 million dollars in New Orleans, blaming the Corps for the failure of the levies which flooded their two nuclear power plants during Katrina!

No wonder ConEd decided to sell Indian Point, get itself out from under a jam. Now ConEd can paint itself as a green company, wash their hands of the whole Indian Point debacle, but they're still buying power from Entergy to flow through their grid. So it's still guilt by association!

Now I ask you, what happens if Entergy goes belly up? Who takes over the operation of all their crumbling reactors? And if nobody wants them, why would anyone want a bunch of broken down facilities long past their due date, ready for mothballs, what happens then? Homeland Security steps in? The Navy is the only branch of the Federal Government left which has the man power, the know how and the expertise to tackle such a task. The tax payer is going to flip the bill, or rather, the Bilderbergers keep minting more fresh bills.

We need to get ready not just for the collapse of the cooling tower at Vermont Yankee last year, but the total implosion of the Shaw/Entergy power company, and its consequences on the lives of the residents of reactor hosting communities. It's not about if Entergy keeps operating its reactors, it's about when their operation becomes so obviously, painfully insane do citizens and politicians finally step in to put Entergy out of its misery before another of their regularly scheduled incidents turn into an accident we can't walk away from.

Yes, Haiti... and so many other problems take precedence and seem so timely. But you know what they need most in Haiti right now? Lights! There's a company in India that makes battery solar powered LED lights, for just $130... and a group in Canada which raises money to install them in Haiti, despite so many relief workers getting shot as anarchy rules on the island. Entergy, which everyone in New Orleans keeps called "energy" because they've been trained since childhood to identity the company with power... should have invested in LED companies long ago. Now they probably will need to divest into them, and wouldn't that be a wonderful thing for 2010.

Sadly Andy Neal never delivered on his commitment to produce the "Grid" lights for Ed Koster and the Catskill Soap Company, leaving a lot of good people in a lurch, who spent a lot of time and effort developing marketing tools and materials, many orders left unfulfilled. We are currently looking for alternative LED professionals to produce low-wattage battery powered lights for booths at fair and festivals. ~ Remy C.)

Some LED lamps on the market are still less efficient than compact fluorescent lamps (CFLs), which have an efficiency of 48 to 60 lumens per watt. This isn't the case with Andy Neal's ANL LTD Illuma design, friend of Rock The Reactors, being installed along the Walkway Over The Hudson in Poughkeepsie, New York celebrating its grand opening October 2nd.

Friday night, after the fireworks display reaches its climax Andy will flip the switch, sending a huge FU to Indian Point, spelling the beginning of the end of Entergy's old plant!

Straight T-5 and T-8 fluorescent tubes are better than CFLs, with efficiencies of 98 to 105 lumens per watt. Although most LED lamps on the market are about equal in performance to CFLs — Cree produces LED downlights rated at 46 to 60 lumens per watt — they cost significantly more than CFLs.

The majority of LED lighting products on the market produce only 10 and 19 lumens per watt — about the same as an incandescent bulb. Testing of LED lights by the U.S. Department of Energy in 2006 and 2007 revealed that most LED manufacturers were exaggerating lumen output. LED devices that were touted as producing 36 to 55 lumens per watt actually produced only 11.6 to 19.3 lumens per watt. Illuma has come a long way since then with 90 lumens per watt.

We want you to test Illuma for yourself. In a few days, Annie Adams's Catskill Soap Company in Bloomingburg, NY and Ed Koster will put "Grid" for sale up on her website and also on eBay.

Grid is ELV (Extra Low Voltage) as far as UL is concerned, no electrical code issues at 12 volts DC. Grid can be connected to any 12 volt battery, including those that can be re-charged by a solar panel. Total power is around 30 watts.

The connectors are industry standard Neutrik 'Speakon' parts, very tough, the cable is also very high spec' it works down to -40C which is basically the artic!

Andy's 12 volts design will retail for $295, manufactured by the Mid-Hudson Workshop for the Disabled and be available in Black or White frames.

It will be marketed to vendors, campers, boaters and anyone who has a backyard. Ed Koster plans on exhibiting at Javits Center Boat Show, display in online catalogs and at Green Drinks in Beacon, NY.

Lighting on the Walkway Over the Hudson will make use of a new system developed by a Dutchess County company.

The project leaders say it will use much less power and save the taxpayer lots of money compared with other lighting solutions once the state of New York takes over and runs the Walkway, due to open in October.

Tiny light-emitting diodes, semiconductors better known by their initials, LEDs, are the source of light.

They are strung together and contained in a tubular one-inch diameter shell that is both the lighting instrument and its conduit, said Andy Neal, president of ANL Ltd., a Salt Point-based developer of Illuma lighting systems.

"The conduit becomes the light," he said.

Meeting held Neal and others working on the project met Wednesday at the Mid-Hudson Workshop for the Disabled, City of Poughkeepsie, which will assemble the lighting system components.

The components will then be installed by All Bright Electric, a West Nyack, Rockland County, contractor that made the winning bid for electrical and security work on the walkway.

Federal transportation money, obtained by U.S. Rep. Maurice Hinchey, D-Hurley, channeled through the city and then to the Walkway, is paying the bill, said Fred Schaeffer, president of the nonprofit Walkway group.

The contract is for about $670,000 and includes electrical work beyond the lighting, Walkway spokesman Steve Densmore said. That covers power outlets, security camera systems and emergency telephones.

Schaeffer said Walkway's team was very satisfied with the lighting solution.

"It provides relatively low- cost lighting," he said. "It's very efficient and you can also direct it down on the deck so it will be lit for safety purposes, but you'll still be able to see the stars and the moon and enjoy the natural atmosphere of the night.

"People are going to be surprised at how beautiful it is," he said.

Neal said, "Because you're using lots and lots of very small sources, it resolves into just a very flat, even illumination."

About 81,200 LEDs will be incorporated into the system that lights the walkway deck.

Bill DelTosta, sales and marketing director for the Mid-Hudson Workshop, said the challenge was that a strip of lights installed on one rail of the walkway needed to throw enough light to reach 20 feet across the deck without creating too much spill upward that would interfere with night vision.

"It's a very tough proposition," he said. "This is the only way it's going to work."

It also cuts the cost of operation by about 80 percent versus the more standard incandescent lights, he said.

James Johannemann, president of All Bright, said, "It's a tough job to be competitive with. It's such a high-profile job for us."

Every American Living Within 25 Miles of A Nuclear Reactor Should File a Pro Se Lawsuit to Build a Nuclear Shelter

For those of us who have the misfortune of living near one of the 104 FAILING NUCLEAR REACTORS in America know two very real facts. 1. The NRC in cahoots with the nuclear industry have been rubber stamping every nuclear reactor license renewal application in the name of saving the industry because of National Interests and Security. 2. Local Nuclear Incident Evacuation Plans will not work, and the NRC has shifted its focus to ordering us to "Shelter in Place" in the case of a significant nuclear incident (terrorist attack, plane accident, or serious breach of containment.)

These two very real realities coupled with the high costs of installing a personal in home Nuclear Shelter have given me much food for thought. It seems very unfair that we as citizens are expected to absorb the $400,000 cost to install and operate our personal shelters, seems unfair we have to take such risks as a cost of having a NRC licensee doing business in our communities. For that reason, I have sent the following letter off to the attorney for Entergy...the licensee for the three reactors in my community. I would strongly suggest that EVERY AMERICAN LIVING WITHIN 25 MILES OF A NUCLEAR REACTOR CONSIDER TAKING SIMILIAR ACTION.

Intent to Sue

For the reasons more fully outlined below, XXXXXXXX hereby formally demands payment for the following costs and damages as are related too the expected license renewal for the NRC licensee sites IP1, IP2, and IP3 and known collectively as Indian Point.

Dear NRC and Entergy:

For the following reasons, I am seeking and demanding legal redress in 1. amount of $400,000 dollars (four hundred thousand dollars) to cover the costs of adequately preparing my property for a potential “Sheltering in Place” incident in my home located at XXXXXXX, Peekskill, NY 10566 should a nuclear incident (terrorist attack or significant accident) occur at the Indian Point site between now and the time the three reactors are eventually decommissioned. This estimated costs that have instituted this demand for payment and notice of my intent to sue are as follows:

A bare bones shelter (http://www.bomb-shelter.net/index.html) (does not include the costs of zoning variances, nor costs of installation is listed for $168,000 and will provide barely adequate space for my wife, I and our six cats for an extended period of time. Estimated legal costs for getting zoning approvals is $25,000. Other necessary upgrades (heating system, fuel tanks, water and waste water storage tanks and their installation has an estimated cost of $80,000. Basic survival supplies to prepare the Shelter have a cost of (as example, the CDC site recommends being prepared to Shelter in place for up to 15 days OR LONGER) $27,000 for a total start up cost of $300,000. The additional $100,000 being sought is the estimated cost of yearly upkeep, maintenance and preparation of the Shelter so that it is always in “Shelter In Place” condition, ready to be used when Entergy or the NRC order us to be sheltered in place during a nuclear incident at Indian Point.

Reasons For This Demand For Payment and Notice of Intent to Sue

Citizens in the 25 mile radius of death that is the PEAK FATALITY zone, including both my wife and I had a reasonable expectation that Decommissioning of all three licensed reactors at Indian Point would have commenced no later than 2015, but the NRC’s nationwide rubberstamping of license renewal applications has pushed out the date of potential Decommissioning of these problem plagued reactors at least 20 additional years, and documents found on the NEI, EPRI, NRC and Entergy websites would lead the average citizen to believe the NRC actually plans on granting a second 20 year license extension to this crumbling and decaying set of reactors. When on compares the costs (average out over 40 years), $10,000 a year to protect HUMAN LIFE, to make sure we have an adequate Nuclear Shelter should it be required, this sum is a reasonable demand necessary to cover the costs of keeping my family safe as a direct result of Entergy continuing to do business three scant miles from my home.
The NRC in conjunction with FEMA and its licensees has made a charade out of the Federal Guidelines and requirements for a workable Emergency Evacuation Plan. In fact and deed, Entergy Officials and members of the NRC staff have both admitted at public meetings held in the host community that the Indian Point Emergency Evacuation Plan WILL NOT WORK (emphasis added) if there is any kind of a significant event occurring on the Indian Point licensees site(s).
Furthermore, the nuclear industry, NEI, EPRI and the NRC have finally admitted in various public forums that “Sheltering in Place” would more than likely be the preferred action to be implemented should a nuclear accident or terrorist attack on a nuclear reactor site occur. This new means of dealing with the safety of the General Public, our families and our pets is a dramatic change that places members of the general public, and specifically my wife and I should a accident or terrorist attack occur at Indian Point in grave danger unless we have adequate access to a certified Nuclear Fall Out Shelter…it is also noted here, that the NRC has only required the licensee to have SPACE TO SHELTER 20 Percent of the citizens in the case of a significant nuclear event at the site.
The current suggestions for sheltering in place fail miserably in protecting myself, my wife and our cats. As one example, the NRC staff, the staff of Entergy and the State Emergency Responders have refused to answer a simple question…if there is a significant nuclear event at Indian Point during a significant winter storm, how long would the average citizen have before they started feeling the effects of thermal shock, started seeing hyperthermia set in. Instead of answering the question, they condescendingly suggested we buy with our own funds the necessary supplies and equipment to survive THEIR ACCIDENT should we be ordered to “Shelter in Place” as a result of a serious nuclear incident at the Indian Point facility. Such a suggestion places an unfair FINANCIAL BURDEN on us as citizens, places a demand on us as stakeholders to absorb the costs of Entergy doing business in our community, forces a costs on us as citizens because NRC is unwilling to enforce their rules and regulations in 10CFR, because FEMA has wrongfully signed off on an evacuation plan that is doomed to failure.
Since “Sheltering in Place” is now the preferred method of dealing with the citizens should a nuclear incident occur, it is only fair that the costs of being able to SAFELY SHELTER IN PLACE be born by the NRC and it’s licensees. The set up costs for such preparation, having an adequate place in which to survive a nuclear incident at Indian Point without negative impacts to our health, the yearly costs of maintaining such a facility are extensive as has been outlined above. It is only fair that those creating the need for such expenditures pay those expenditures.

For this reason, I am making a demand for payment and giving notice of intent to sue against both Entergy, and the NRC, and am encouraging every citizen in every host community in America to follow suit to file suits as Pro Se litigants in their own local courts. I am further making this demand for payment in preparation of filing suit to protect my rights and health as a citizen of the United States of America. Entergy, the NRC and even the Federal Government have a duty to protect human health and the environment.

This duty takes on special importance in communities across America where citizens are having the NRC force them to play host to dangerous nuclear facilities for an additional twenty years of operation.

A license renewal, continued operation of these facilities places new and unexpected risks on host communities, on citizens living in the peak fatality zone. It is only fair that the NRC and its licensees pay the costs incurred by citizens who seek to adequately prepare themselves for the accident we are constantly told to be ready for…as example, the constant testing of the Emergency Notification System. For these reasons, XXXX hereby makes a demand for the sum of $400,000 to build and maintain a personal Shelter at his residence located at Street in Peekskill, NY. Failure to respond with payment of this Demand in 30 days, failure to open up meaningful dialogue towards settlement will result in further legal action to protect my rights, protect my health, and to assure I have the capability of obeying SAFELY a Federal Governmental Agency order to “Shelter in Place” when the time comes, and trust me, the time will come, if not in my own neighborhood, then in another host community that has wrongfully been forced against their will to play host to a aging, failing nuclear reactor for 20 additional years.

Public Advocacy Groups and Attorney General to Argue Against Nuclear Regulatory Commission’s Unsafe Fire Safety Exemption Granted to Indian Point before the United States Court of Appeals for the Second Circuit

On Monday, May 11 oral arguments will take place at the United States Court of Appeals for the Second Circuit Ceremonial Court Room, 9th floor, 500Pearl St., New York City at 10:00 a.m. in a case that has been brought against the United States Nuclear Regulatory Commission (NRC) by several public interest groups including the Westchester Citiz en’s Awareness Network (WestCAN), the Rockland County Conservation Association, Inc. (RCCA), the Public Health and Sustainable Energy (PHASE), the Sierra Club’s Atlantic Chapter, and Assemblyman Richard Brodsky (D-Westchester), and New York State Attorney's General Office has filed an amicus brief. The groups challenge the NRC’s decision to exempt Indian Point Nuclear Facility Unit 3 from fire safety regulations that reduced fire safety standards from one hour to twenty-four minutes.

Under the NRC regulations, a nuclear power facility built prior to 1979 must enclose the cable and equipment necessary for a safe shutdown by using a fire barrier with a one-hour fire rating. According to the exemption Indian Point’s fi re rating has been reduced to twenty-four minutes, a 76% reduction fire safety standard.

Since 1993, the NRC has known that the fire barrier utilized at Indian Point does not meet the one-hour duration. According to the 1993 test, the fire barrier only lasts 23.2 minutes, however the NRC took no action unti l 2005. The 2005 test confirmed that the fire barrier failed to perform for one hour and exceeded temperature limits within thirteen to forty-two minutes.

In 2006, the NRC issued a letter to certain nuclear plants requesting that they propose a resolution for the problems associated with the fire barrier. In response, the owners of Indian Point nuclear facilities, Entergy Nuclear Operations, Inc., requested an exemption from the one hour fire safety standard. On August 16, 2008, the request was revised requesting a reduction from one hour to twenty-four minutes for certain areas. Thirty four days later the NRC granted the exemption.

The result of the NRC’s decision to gr ant the exemption from one hour to twenty-four minutes means that a single fire must be detected, fire brigade assembled and fully extinguished in less than twenty four minutes. Like most operating nuclear reactors, Indian Point Unit 3 contains miles of electrical cables that control and power safety systems, including valves, pumps, motors, and gauges designed to ensure the prompt shutdown of the nuclear reactor. A fire at Indian Point that damaged those cables could disable the critical systems served by the cables preventing safe shut down and ultimately may lead to a major radiation release that could have a disastrous impact on the health and property of the people of New York.

Petitioners will argue that the NRC improperly granted the “exemption”, lacked authority to grant exemptions, failed to allow required public participation, failed to give proper notice, failed to consider relevant evidence in making its decision, and violated National Environmental Policy Act. Petitioners will further argue that the NRC created a potentially illegal loophole by permitting mischaracterization of the request as an “exemption” rather than an amendment, thereby violating the Atomic Energy Act.

The NRC’s decision drastically compromises the safety of the Indian Point nuclear facilities. Upwards of twenty million people work, live, or travel within fift y miles of Indian Point. This case marks the first time the NRC’s right to grant exemptions without notice and hearings has been challenged.

The case will be argued on Monday, May 11 before Honorable John M. Walker, Jr., Honorable Sonia Sotomayor, and Honorable John Clifford Wallace of the United States Court of Appeals for the Second Circuit.

Assemblyman Richard Brodsky will be arguing for the Petitioners. Assistant Attorney General John Sipos, Esq. will be arguing on behalf of the New York State Attorney General’s Office. A representative will be arguing on behalf of the NRC, as well as a representative from Entergy Nuclear Operations, Inc..

In the past months there has been a growing concern that France's aging nuclear power infrastructure has gone from bad to worse, with critical leak and waste problems. Sadly the majority of French nuclear power plants were built in the heart of wine and cheese country, where cows graze and grape grow.

French farmers pride themselves on bio, what we mean by eco, producing some of the best wine and cheese on the planet. But today, because of the rising levels of ionizing radiation coming from nuclear power plants that were built to run only 25 years, not 40 since President Pompidou handed EDF over to Westinghouse.

In solidarity with French farmers, a boycott of potentially irradiated wine and cheese products made from contaminated water, would urge the French authorities to set up transparent radiation monitoring measures of all wells, streams and rivers affecting agricultural regions.

France is facing an unsurmountable decommissioning and waste disposal future. Not having invested in an alternative energy infrastructure as their neighbors did, France is the driving force putting extraodinary pressure on the rest of the world to dive into a nuclear renaissance, this despite the clear evidence that nuclear power is no longer a viable, cost effective way of producing electricity.

So we'd like to call on the boycott of French wine and cheese products until it can be demonstrated that they are all free of contamination.

USS Hartford Nuclear Propulsion System Leaking Radioactivity...Is Reactor DAMAGED...

The USS Hartford docked at Mina Salman pier has apparently been surrounded with protective booms as local Public Commission for the Protection of Fisheries, Environment and Wildlife Shaikh Abdulla bin Hamad Al Khalifa issued orders for the officials concerned to follow up on the environmental impact the incident may have on Bahrain. It was first thought that this piece of information concerned the 25,000 of Light Crude/Diesel that the USS New Orleans spilled when a 16-18 diamter hole was punched into its hull...it now turns out there could be far more worrisome issues.

It seems that Shaikh Abdulla bin Hamad Al Khalifa wants WATER SAMPLES from under the Nuclear Fast Attack Sub USS Hartford to ascertain the severity of the RADIOACTIVE LEAK!

He said that officials are monitoring the situation with the US Navy regional environment affairs co-ordinator and Mutual Emergency (MEMAC) and Bahrain port authorities after the vessels were transferred to Bahrain waters for maintenance work.

"We ensured containing the environmental impact from the oil leaks with the use of rubber booms," said the spokesman.

He said that the public commission requested the US Navy to be provided with samples from under the submarine to be analysed as soon as possible at one of the neutral labs in the region.

"The move aimed at establishing the level of the radioactive leak," said the spokesman.

He said that Bahrain authorities also requested an urgent report on procedures that ensure safeguarding marine environment and the health of the workers during maintenance work on the submarine in Bahrain.

"The public commission, in co-ordination with the Royal Navy, learnt that the submarine's fuel was not affected from the collision," said the spokesman.

"The US Navy regional environment affairs co-ordinator also assured us in an urgent reply that the submarine contains measuring and early dedication equipment to monitor any leak of nuclear fuel." (These are the same hallow false propaganda reports the NRC gives us all the time...same thing we heard when Indian Point leaked 100,000 of tritium laced water into the Hudson River, the same excuses they give to deny their guilt in my wife's cancer...what is the real truth MC2 Kirby?)

"We would like to assure all Bahrain residents that the situation is being closely monitored by the authorities concerned." My suggestion to the citizens of Bahrain...TRUST BUT VERIFY as Mr. Reagan used to say...the Nuclear Navy is not above giving you FAKE WATER SAMPLES....have your own divers collect the samples.

Greetings Anti Nuke Friends...This is an all hands on deck moment, our chance to hand the entire group of Commissioners a serious gut punch for CHEATING when it comes to the DBT. I was (which is not unusual) upset when I learned the Commissioners had once again voted against staff recommendations regarding the strengthening of the DBT (Design Basis Threat) document which dictates what weapons a licensee must be capable of defending against.

I did what I usually do...fired off a scathing ACCUSATION which outlined some of what I know to be a fact, pointing out why I knew the Commissioners were worshipping at the Nuclear Temple of Taint at NEI. Good news...the Inspector Generals Office has informed me that they are going to investigate my allegations, want to set up a time to interview me further on my allegations.

This is where all you in the Anti Nuclear Arena come in, and can become involved. ANYTHING related to REACTOR SECURITY (which if you think about it is ALMOST everything) and the DBT that you want addressed email to me via this email. I am specifically interested in instances where you feel the Commissioners have cheated on the DBT, or have ignored your CONCERNS and ALLEGATIONS regarding the DBT and security issues. Dear Inspector General:

As an Anti-Nuclear environmentalist, I have grave concerns when it comes to all things surrounding the Military/Commercial Nuclear Industry...simply stated, there is more than adequate reason not to trust anything put out in the way of Propaganda from the Nuclear Industry (through NEI) or our government through various and assorted agencies (DOD, DOE, NRC, and yes, the US Nuclear Navy).

It does not take a rocket scientist to realize the horrific collision of the USS Hartford with the USS New Orleans was/is far more serious than the Navy is letting on. The few available pictures of the USS Hartford fast attack submarine show SERIOUSLY broken welds around the sail. The Conning Tower is canted from stem to stern, suggesting that periscopes are no longer working.

Further, it is my own belief and allegation that such a significant collision has impinged upon the reactor cores cooling capabilities. It is my belief that any attempts to navigate the USS Hartford back to America under its own power endanger the crew of the USS Hartford, as well as the citizens of the world, and our environment.

It is therefore respectfully requested that your office open up a FULLY PUBLIC investigation of how the accident occurred, and just what damage has been done to both vessels. This investigation should include inspection of the entire nuclear propulsion/cooling system to assure the safety of the world population. Said inspection should take place after the nuclear submarine has been returned back to America using the same technology used to transport the USS Cole. (see photograph)

World public health, the safety of the grew, and the protection of our world oceans should supercede whatever Middle East Agenda the USS Hartford was carrying out. When already we are hearing rumors of water tight doors below deck being incapable of closing, the Navy cannot and must not needlessly risk lives of our American Sailors.

A nuclear submarine was damaged in a collision with another U.S. Navy vessel off the coast of Iran early Friday, leaving 15 U.S. sailors injured and 25,000 gallons of fuel spilling into the Strait of Hormuz.

The USS Hartford, a nuclear-powered fast-attack submarine, was fully submerged Friday when it collided with the transport ship the USS New Orleans, according to a Navy official in the 5th Fleet. Seas were calm but visibility was low as the incident occurred around 1:00 a.m. local time.

No official reason has been given for the accident but a Defense Department official told FOX News that "it appears the two vessels were not in communication before they collided."

Fifteen sailors aboard the Hartford were slightly injured but able to return to duty. No injuries were reported aboard the New Orleans, according to the Bahrain-based 5th Fleet. It was the Los Angeles-class submarine's first deployment.

Hey Richard Barkley....Still Waiting For that DBT Meeting

Some time ago I brought some serious concerns about the DBT to the attention of the NRC. After much delay and excuses, after being told at a public meeting on the record that my concerns would be addressed in a PRIVATE MEETING, I am still waiting. So am curious there Mr. Chairman of the NRC...when do I get to look at the DBT and have my concerns addressed? Meanwhile, from Green Nuclear Underground, a citizens imagination of what could be on the DBT that the NRC is not letting us see...just what RISKS are we facing from terrorists if they Relicense Indian Point. I think we have a right to know, have a right to see the DBT.

Hey NRC...What is in the DBT?

One of the big complaints that host communities have in being forced to host dangerous, failing reactors for another 20 years (besides the fact that they are American Chernoby's waiting to happen) is the fact we are not allow to have any real say in the DBT, nor any idea of what is or is not included in the DBT. Simply stated, we are left to our imaginations. Since the NRC will not honestly let us as Stakeholders know what SECURITY RISKS we face in the event of a terrorist attack, since we do not know what the SLEEPING GUARDS can actually protect against, thought I'd share a few weapons that MIGHT be on the DBT...maybe the NRC will realize truth and open honesty with HOST COMMUNITIES is far less dangerous than our run away imaginations...or not.

Special Operations Forces Demolition Kit
(SOFDK)

The SOFDK contains a variety of inert items that, when field loaded, provide Special Operations Forces with the capability to tailor charges to the target by using SDK components and C4 or other moldable explosives. The kit provides several methods of attaching charges/munitions to targets. The overall intent is to allow the operator to construct the smallest, lightest charge feasible with the greatest standoff distance attainable and maximum precision. I have a question....how can this type of stuff be put up on EASILY ACCESSIBLE PUBLIC WEB SITES, but we cannot see the DBT? Could it be the NRC does not want Host Communities to know just how PATHETIC Reactor Site Security is?

The Helen Keller Brain Salad Directed Energy Sandwich Nuclear Comparison

America's Nuclear Reactors are perhaps some of the most critical infrastructure in America, and also some of the most poorly guarded...as example, the NEI was successful in convincing the NRC that Bullet Resistence Glass was fine when weighed with what it would cost the Licensees to upgrade their guard towers! That might sound like a lot of money, the industry position reasonable until you take a look at the DOD and their Directed Energy Directorate located at the Phillips Research Site, Kirtland Air Force Base, New Mexico. The Directorate has a workforce of more than 600 people, an annual budget exceeding $130 million, and 670,000 square feet of working space. What do they do? Look for ways to blind large groups of protesters with pulse weapons while they turn your brains into egg salad. (Right now, they are looking to control the lazer pulses enough that they do not do permanent eye damage. Take Microwave oven doors to your next Anti Nuclear sit in to make a group shield with.)

The Advanced Optics & Imaging Division develops techniques and technologies to improve optical systems, and then transition those systems to war-fighting commands. The Division also is working on systems that will accurately place a beam of laser light on a target such as an attacking missile. Much of this research is in support of the Air Force's Airborne Laser program.

The High-Power Microwave Division is the Air Force's center of excellence for high-power microwave technologies, managing all research and development in that area. This includes high-power microwave hardware and systems, as well as protection against an aggressor's microwave systems.

The Laser Division is the Department of Defense's center of expertise for the development of lasers and for getting those technologies to U.S. military forces. Included are semiconductor, gas, chemical, and solid-state lasers.

The Commercial Nuclear War Machine Rumbles On...The Ugly Tritium Truth

FIRST NUCLEAR SUB IN NEW YORK HARBOR

It has been the contention of this author (for decades) that you cannot separate the Commercial Nuclear Industry from the Military Nuclear Industry as they are equal parts of the whole that is the Siamese Demon Spawn that is the Commercial/Military Complex. I came to this conclusion early in the 80's as my knowledge base on the Gaseous Diffusion plants in Paducah Kentucky and Portsmouth Ohio increased, was solidified when I drove around the Portsmouth Facility, saw the miles upon miles of stacked up, rusting barrels of Depleted Uranium.

I've felt all along that the Anti Nuclear Groups needed to JOIN FORCES with those who opposed Nuclear Weapons, have bemoaned the lack of worry the Anti-Nuclear Weapons folks have given to commercial nuclear reactors....especially in the last say ten years as the NRC races to rubber stamp the License Renewal Applications of America's 104 Ancient Nuclear Behemoths, failed reactors left over from a failed nuclear legacy that the DOD, DOE, NRC and the nuclear industry desperately want to keep up and running to save the industry, and...COULD IT BE THE UNITED STATES NUCLEAR ARSENAL?

PAY ATTENTION FOLKS

One of the BIGGEST problems that the NRC has been ignoring of late is the TRITIUM leaking from an ever increasing number of American Reactor sites. The latest example of this was the UNDERGROUND PIPE RUPTURE at Indian Point on February 21st of this year. The licensee estimates some 100,000 gallons of tritiated water RUSHED into the Hudson River as a result of this significant accident. The NRC Propaganda Team was quick to rush out to the medium with their patented, "No harm no foul" message that stakeholders were never in any immediate danger. (Notice the slick use of the word IMMEDIATE?) Further, the NRC, NEI and the entire nuclear industry are going to a whole lot of trouble to MAKE AMERICANS COMFORTABLE with Tritium LEAKING INTO OUR ENVIRONMENT...WHY?

GOD, WHAT A BRILLIANT QUESTION!

First, how many of you knew that the DOE/DOD used to operate two Military Reactors whose sole purpose was the PRODUCTION OF TRITIUM?...DOES THAT HAVE YOUR ATTENTION?

How many of you knew that those two reactors were permanently closed down in the early 90's for SERIOUS SAFETY CONCERNS?

Tritium is a radioactive isotope of hydrogen used to enhance the explosive yield of every thermonuclear weapon. Tritium has a radioactive decay rate of 5.5% per year and has not been produced in this country for weapons purposes since 1988 when the K Reactor at Savannah River Site in South Carolina was shut down for safety reasons.

COME ON FOLKS, THINK FAST, THIS IS GETTING FUN!

Tritium's decay rate of 5.5 percent a year means that THERMONUCLEAR WEAPONS NEED TO BE RECHARGED on a FAIRLY REGULAR BASIS...the only place to get Tritium is from the operation of NUCLEAR REACTORS! ARE YOU SEEING THE LIGHT BULB YET?

Where are armies of citizens into the tens of thousands storming to the gates of every Nuclear Reactor Site in America that is LEAKING TRITIUM...we are being poisoned for THE WAR WHORES!

Proposed Rule Change Comments (Which Are Due Today)

Because the NRC has shown it cannot be trusted, because they are despicable villains out to visit death on reactor host communities, am taking the liberty of posting here on GNB the comments just submitted on the NRC's proposed rule change that would see spent fuel waste left sitting at reactor sites in Dry Casks that have a 20 year life span for over 100 additional years because of the nuclear industry is incapable of dealing with their long term storage responsibilities for the most dangerous wastes created by mankind. Again, playing the part of Doctor Mengele, the employees of the NRC are showing they will stoop to any level to preserve the nuclear industry, and thus their agency and their own jobs. This incestuous circle jerk between licensee and regulator must be stopped.

Dear NRC:

I am writing as a stakeholder living within 3 miles of a failing nuclear reactor to object to the proposed rule change announced in the Federal Registry relating to the continued and mislabeled temporary storage of spent fuel at nuclear reactor sites after cessation of operations as is found in Part 51 of the Rules and Regulations that the NRC for the most part has waived (in the form of Generic letters and findings) for their licensees with whom they have an unhealthy even incestuous regulatory relationship with that has resulted in the protection of human health and the environment taking a second seat to the NRC and NEI's co-sponsored scheme (can we say racketeering?) to keep antiquated reactors up and operating at all costs in the name of supposed National Security and to get Wall Street on board with their own desires for a Nuclear Renaissance here in America. The great nuclear energy experiment known as the peaceful atom has been a dismal failure, and in 50 years the military/commercial nuclear industrial complex have failed in their most crucial task...dealing with the most dangerous and lethal wastes known to mankind, and giving them through this proposed rule change an additional 130 years with which to desperately seek answers and solutions is completely unacceptable to host communities and stakeholders such as myself. Our contract with the government, with the NRC, with their licensees calls for these waste streams to be removed in a TIMELY FASHION, and we expect that contract to be honored, rather than having a bunch of ego driven liars at a failed Regulatory Agency (that would be the NRC) trying to foist a scam off on the nation and the world by pushing their duties down the road onto the backs of children that will not be born for another 3 or 4 generations to come. That reality, and thus these rule changes are unacceptable.

First, as a stakeholder living within 3 miles of Indian Point, I take exception with the NRC's fundamentally flawed decision NOT TO DO a Draft Regulatory Analysis of this regulation, as they foolishly believe and contend it does not place any and/or additional burdens on their licensees. This amendment as written fundamentally EXTENDS the envisioned time that Spent Fuel waste streams will remain at/be stored at licensee sites, thus DEFACTO adds additional burdens for both the licensee and THE HOST COMMUNITIES who are now, UNDER DURESS, (emphasis added) being forced by the NRC as a result of their illegal, dishonest and corrupt license renewal process to play host to fundamentally flawed and dangerous reactors that are operating far above safe capacity limits, and beyond their safe periods of operation as both licensees, the NRC and their partners in crime the NEI, DOE and EPRI play Russian Roulette with public health and safety in the name of a Nuclear Renaissance that is not likely to arrive taxpayers in light of our failing American Economy are going to rebuke any attempts to have us pay the $1.5 trillion dollar price tag for a new generation of reactors, are not going to be willing to give robber barons in the industry and the NRC the loan guarantees they seek. This as an aside is just another reason why the NRC's rule change seeking an additional 100 years to deal with waste streams should be DENIED...the industry is dying (as it should) and the costs and problems associated with its waste streams must be dealt with now, rather than foisting the responsibility off onto the backs of our great, great grandchildren's children.

Webster's defines burden as something oppressive or worrisome...by shear definition of the word burden, this proposed rule change requires the NRC to have conducted a Draft Regulatory Analysis. A rule change of this magnitude cannot be made without NRC Licensees taking on the burden of reviewing the rule and its impacts (both real and potential) on themselves, their reactor sites, and their corporations...simply stated, that is a burden in and of itself. In its usual fashion of mitigating the publics right to be fully involved in these processes, in their usual attempts to force communities to accept unreasonable risks with little or no say, the NRC is again trying to manipulate and play with the rules to defacto site 104 mini long term storage facilities in reactor host communities in what amounts to a criminal action on their part to ABANDON REACTOR WASTES across the American landscape, while allowing corporations to duck out from under their legal and moral obligations to remove these waste streams from the reactor sites and return said sites to the communities in a timely fashion for unrestricted use and enjoyment.

Further, the United States Government, the DOE and NRC's inability to site, license and build a LONG TERM DISPOSAL facility in a timely manner (it is pointed out here the dismal failure of the envisioned compact system, as well as snags that seem to have ship wrecked George Bush's criminal actions to force Yucca Mountain on the people of Nevada which the NRC participated in) makes this proposed rule change a farce at best, and at worse a deliberate, malicious criminal intent to mislead the citizens of America, and to permanently saddle nuclear reactor host communities with DEFACTO Spent Fuel Storage faculties without any of the protections they should and would normally be afforded if the NRC were actually siting and licensing them for what they are. As example of this permanence we refer to the numerous and dangerous waste streams from IP 1 which was closed in 1974...some 35 years later, no action has been taken to even begin the decommissioning of the reactor itself, and all of its generated waste streams will remain in (for practical purposes) permanent storage for perpetuity since these new proposed findings would push back dealing with these waste streams at least another five generations. Leaving reactor waste on site in overly populated areas for periods of time in excess of 100 years amounts to a default long term radioactive waste disposal facilities, and as such, these rule changes should and must entitle every host community the rights and protections they should be afforded when such a MAJOR FEDERAL ACTION IS TAKING PLACE, which means these sites must be licenses for what they are, and that means hearings, that means full blown EIS and risk assessment procedures, and it means we have the right as communities to REFUSE YOUR STINKING LYING PROPOSAL FOR OUR COMMUNITIES, have the right too tell you and the nuclear industry to go fuck yourselves, and the fact that you do not like our message, or the way in which we deliver it does not give you the right to ignore it or dismiss it.

In 51.22 as proposed, it reads in part...

We first should look again to the dictionary which defines temporary as lasting for a LIMITED TIME (emphasis added). It is further pointed out, that said limited time was SET IN STONE and AGREED TO BY ALL PARTIES at the time the original license to operate a nuclear facility was granted...said date certain was to be no more than 60 years from the date a reactor was taken out of service, at which point in time the site was to be decommissioned to a point where the LAND COULD BE RETURNED TO THE HOST COMMUNITY FOR FULL USE AND ENJOYMENT WITH NO RESTRICTIONS. The NRC's inability to successfully find, locate, site, license and BUILD a long term disposal facility in a timely manner has defacto created Long Term High and Low Level Radioactive Disposal Facilities in every nuclear reactor community that do not have the safeguards and protections which are called for in the NRC's own citing criteria. The fact that these criteria exist, have been written is further solid proof that there are CERTAIN KNOWN and QUANTIFIED RISKS TO BOTH HUMAN HEALTH AND THE ENVIRONMENT that need to be safeguarded against when these wastes are being stored/disposed of in a particular location. These proposed rules make it obvious that current reactor sites are being turned into DEFACTO long term storage facilities for these dangerous waste streams (100 plus years IS LONG TERM) and this reality must be admitted by the NRC, and once admitted to, they must afford us as stakeholders OUR LEGAL RIGHTS, including having these sites go through and meeting all licensing requirements required within the rules and regulations as found in 10 CFR.

Storage of these wastes is not envisioned as being temporary, and in fact and deed the NRC's own internal documents show their true intent of storing said waste streams WHERE THEY SIT for periods in excess of ONE HUNDRED YEARS! Spending any time at all reviewing the various documents available at EPRI's online site will prove this out. This is very germane to the very concept of this envisioned rule change, the very concept of TEMPORARY as presented in this proposed rule change. OVER 100 YEARS is not temporary, far exceeds the maximum 60 year period to release the sites for unconditioned use as was agreed to with the host communities, but more importantly, far out strips the life span of both spent fuel pools currently being used for storage (many of which are now victims of significant leakage issues), as well as the maximum LICENSED usage period of the Dry Casks that much of the waste is now being illegally transferred into. Dry Casks are licensed for a period of only 20 years...NRC's requested rule changes, the changes to their FAKE FINDINGS that are not back up with any meanful scientific findings seeks to leave wastes where they are in Dry Casks that are only licensed for 20 years of safe usage for a period of time five time longer than that period of time....are they planning on IGNORING SOUND SCIENCE and SIMPLY TAKING A CHANGE AND LETTING SAID WASTES SIT IN THOSE CONTAINERS for and EXTRA 80 years hoping for the best? Are they planning on having said wastes transferred into a series of new casks as this period of lapses, and if so does that not create additional BURDENS, and further who will pay the costs for this on going litany of new dry casks, and the transferred fees associated with them...what about the long term storage of the USED Dry Casks?

100 years is a marker of significance, and as proof of this, it is pointed out that such a milestone of PERMANANCE would make these DEFACTO LONG TERM HIGH LEVEL WASTE STORAGE FACILITIES that the NRC is illegally creating illegible for inclusion on the list of Historical Sites, deemed National Treasures worthy of being preserved for all time as LANDMARKS of AMERICAN ACCOMPLISHMENT! With all due respect, these unlicensed and dangerous defacto waste sites are not the Lincoln Monument.

The time has come to take off the Sheep's outfit and expose the wolf for what it is...the NRC in illegal collusion with their licensees and with the full cooperation of other agencies of the Federal Government (DOD and DOE come quickly to mind) are through the implementation of this and other rule changes attempting to create in perpetuity Mini Long Term Radioactive Waste Disposal Facilities that have not been properly sited, licensed, built, have not gone through the required formal EIS that would be required for such SIGNIFICANT FEDERAL ACTIONS, and that are saddling host communities with duties, responsibilities and risks (both from a environmental/health perspective, and from a security/terrorist perspective) that we have not agreed to be a part of, have not been adequately compensated for, and have not had a say in via the normal PUBLIC PARTICIPATION PROCESS we are entitled to. In short, the NRC as is usual is attempting to GANG RAPE 104 innocent communities, trying to scar our landscapes for generations to come without us having our moral and legal say in the process...in short, the NRC who is supposed to protect communities, the NRC that is supposed to place public health and safety above all else has become a predatory agency out to victimize the very people they are sworn to protect...perhaps it is time that we have a sister predators list to match that kept on sexual predators that has the pictures, addresses and names of the regulatory predators that have ruthlessly gang raped innocent communities, callously and indiscriminately visiting nuclear abortions and cancers on communities as they see fit in their evil and twisted plans to preserve their beloved nuclear industry.

It is pointed out here, that the language as written in this rule change is deliberately vague and ambiguous thereby leaving host communities with AN OPEN ENDED OBLIGATION to PLAY HOST TO DANGEROUS WASTE STREAMS that were already supposed to have been removed from these (supposed) temporary storage areas into a permanent LONG TERM DISPOSAL FACILITY. It is further noted, that we through a surcharge tacked onto our monthly utility bills have ALREADY PAID FOR THIS LONG TERM STORAGE FACILITY TO BE BUILT, and FOR THE WASTE STREAMS TO BE REMOVED FROM THEIR (supposed) TEMPORARY locations at current reactor sites. Specifically, the proposed rule states these waste streams would be allowed to remain where they sit until a storage facility can reasonably be expected to be available...this creates AN OPEN ENDED LEGAL OBLIGATION on both the general public, and on LICENSEES that exceeds their currently expected requirements and obligations...in short, it CREATES ADDITIONAL BURDENS, therefore making it NECESSARY to perform A DRAFT REGULATORY ANALYSIS. Further, reasonable minds would agree that these sites are not envisioned as temporary, but in fact and deed are permanent, and being permanent must be LICENSED for what they really are...this means the DOE applying to the NRC for 104 Licenses to operate High Level Radioactive Waste Disposal Facilities across America...the EIS for such a site where the waste sits at the Indian Point reactor site COULD NEVER GET APPROVED, and the NRC knows this, which is why they are trying to anally back door our community into playing host in perpetuity to these dangerous waste streams. As the husband of a wife who has suffered breast cancer as a result of Indian Points operations, I flatly reject this unlawful attempt by the NRC to place a long term storage facility in our community, and state for the record that all employees who are playing a part in this charade are CRIMINALS who are committing treason against America as a nation, and are guilty of regulatory raping of 104 reactor communities who are being forced to host these monstrous machines of death and birth defects.

Furthermore, we need to closely examine the term reasonably expected to be available...that infers/intones some envisioned FUTURE DATE and TIME that when reached would see the waste streams removed from their so called temporary storage places...problem is, the NRC, DOE and the entire nuclear industry have a DEPLORABLE TRACK RECORD when it comes to dealing with their waste streams in a RESPONSIBLE MANNER, when it comes to meeting REASONABLY EXPECTED TIME LINES FOR AVAILABILITY. As a point of fact, I would point out that the original compact plan pushed forward by the DOE for Low Level Radioactive Waste storage in the very early 80's as a part of the negotiations that created these waste assurance findings was riddled with corruption, and collapsed (see Midwest Compact as perfect example of this claim and proof of its accuracy). Furthermore, as of right now (a reality that has been true for well over two decades now) the Federal Government, DOE, NRC and the Nuclear Industry know for a fact that Yucca Mountain is dead as a long term storage solution for these waste streams. Going further, GNEP is also fatally flawed, and even if the technology could work, it does not RESOLVE the long term storage problems for these lethal radioactive waste streams that are already causing known cancer deaths and stillborns in our communities. In short, the NRC through these actions are attempting to legally operate miniature DEATH CAMPS in every reactor community, are playing the part of Hitler deciding what is an acceptable level of deaths in meeting their goals of seeing a Nuclear Renaissance here in American...sorry, but communities should not be forced to accept a modern day Dr. Mengele using us for his own sick and twisted human experiments to find what is and acceptable risk dose that communities and our children can be exposed to in the name of National Security, in the name of a nuclear renaissance.

It is pointed out here, that the fuel streams that would be created through GNEP's envisioned reprocessing first and foremost could not even be BURNED in the NEXT GENERATION nuclear reactors such as the AP1000, which would mean creation of new reactor fuels where no market even exists, and would not exist for at least another 100-150 years. More importantly, this reality, this new fuel being envisioned is going to be highly enriched BOMB GRADE feed stock which opens another whole can of worms that have not been reviewed and weighed by our Government. Though these issues are at best secondary to the manner now before this commission, they add substance to the claim that there is NOTHING TEMPORARY in the nuclear industry and the NRC's plans when it comes to leaving these dangerous waste streams where they sit...in short, the NRC is attempting to DEFRAUD the citizens of the United States of America, are attempting to perpetuate a crime on every reactor host community in America, are attempting to sidestep the safeguards that public siting processes would afford host communities when LONG TERM SPENT FUEL STORAGE FACILTIES are being proposed for a chosen community and or location. If these changes are accepted, the NRC should be required to place 12 foot prison fencing around the ten mile circle of death that is the nuclear fall out area in the case of a significant accident at one of these sites, and declare our communities defacto concentration camps...we already have the potential ovens sitting here on the Hudson, have already seen that planes can crash into them...see the recent crash landing of a 747 into the Hudson River, and replay the video of not one, but two planes crashing into the World Trade Centers. We are being forced into Death Camps, some of us will be killed by cancers caused by these waste streams, others of us will see our children suffer Nuclear Abortions at the hands of the NRC and its licensees as it is a proven fact that living in close proximity to these waste streams greatly elevates a woman's chance of pregnancy ending in a stillborn birth, know that children are exposed to higher rates of leukemia, and that woman's breast cancers rates are greatly enhanced...lets label these reactors properly....they are nuclear machines of death, their locations and the communities forced to house them defacto DEATH CAMPS with the Chairman and Scretary of the NRC playing the part of Dr. Mengele.

Moving on, let us discuss the proposed changes to the Waste Confidences rules that the agency is wanting to implement. The first SIGNIFICANT change would be to finding number 2 which would now read as follows:

It is pointed out here, that the Nuclear Industry in its first 50 plus years of operation has failed to keep its promise of finding/implementing a long term storage solution for these waste streams. Even ignoring past deadlines that have been missed by all significant parties (NEI, EPRI, NRC, DOE, DOD and all nuclear licensees) in the military/commercial nuclear cycle, ignoring all previous obligations and deadlines they have missed, and turning only to the most current one wherein these parties stated Yucca Mountain would be open, and accepting wastes by 2017...the DOE, NRC and NEI have now admitted that deadline cannot and will not be met...furthermore, and even more troublesome is the fact that even IF (which is a big if) Yucca Mountain is ever open, its capacity is already filled up by a magnitude of at least three (as in the government would need to build three Yucca Mountains to handle currently existing waste streams, let alone the newly created waste streams which will result from the unlawful relicensing of American's existing 104 ancient reactors). GNEP is yet another part of the same scam...its another attempt to change a waste stream into a potential future use resource in a shell game identical in its illegal scope to what DOE, DOD and the folks at the Gaseous Diffusion plants did with the vast stockpiles of depleted uranium when they decided it could all be used to make armor piercing munitions...the same munitions by the way that make the NRC's DBT for reactor sites fatally flawed since an average sniper could take out (as example) Indian Point's guard tower with a high power 50 caliber rifle.

With finding 2, the NRC is being first and foremost dishonest with their stakeholders, as they already know they cannot meet even the newly established benchmark that this change would create of 80 years down the road from the day the change was officially codified into law. Using Indian Point as example, should their license renewal application be illegally rubber stamped and approved by the NRC as they have done with every other application that has come before them, the NRC would not have to have a storage facility ready and operational until approximately 2093, and if, as we expect, they change the period of license renewal from 20 to 40 more years of additional operation, that obligation date would move even further into the future until the year 2113! This proposed rule amounts to a radioactive waste ponzi scheme wherein the obligations to safely and permanently deal with the radioactive waste streams being created by the NRC's licensees are being pushed ever further and farther down the road to be dealt with by citizens that will not even be born yet for 3-4 generations to come...it is bad enough to con those of us who are living, but to con generations of citizens yet to be born is the worst kind of crime that can be envisioned, a far more dastardly and evil intention than those harbored by Hitler himself...are my words inflamatory...ABSOLUTELY and deservedly so...we have a agency of the Federal Government that has ignored and flouted the law, has rubber stamped the license renewal applications of dozens of fatally flawed and dangerous ancient reactors over the objections of host communities who no longer care to play host to these monsters, we have a Federal Agency that deserves the label Agency of Death, the Nuclear Grime Reaper of the United States Government, and these rule changes have crossed a line, must be called for what they are...the nuclear raping of every host community in America.

The DOE, DOD, NRC, NEI, EPRI and their various licensees and contractors have a DUTY AND RESPONSIBILITY to honestly and fully deal with and dispose of their waste streams...asking the American public to give them in total (if this rule change were to go into effect) a cumulative total of 130 years before we see the first ounces of Spent Fuel going into proper and safe licensed long term disposal facilities is simply unacceptable...in fact, as a part of these comments and this process, it is officially requested here, that a moratorium be declared on any further licensing and/or re licensing of nuclear faculties and/or reactors until such time that the DOD, DOE, NRC and their licensees and contractors have met their existing obligations to SAFELY DISPOSE OF THESE WASTE STREAMS OFF SITE...the NRC should be willing to accept this moratorium since their currently existing Finding as relates to Waste Confidence suggests they can in a timely fashion site and build a disposal facility for these wastes....the time line as it currently exists would see them having said site up, built and accepting waste streams some 80 years sooner than they would be required to have it done in should this newly created fraud as worded in the proposed changed language be allowed to stand. The time for fraud must come to an end, the three card Monty Shell game mentality of where the waste is going to be stored must stop...you do not deal with your obligations by constantly moving the marker down the track, foisting your moral, legal and financial obligations off onto future generations yet to come, and the NRC has played this card too many times already, and must not be allowed to play it again this time around. There death of indiscriminately visiting additional deaths onto their host communities in the name of the greater societal good must come to an end...millions of soldiers fought and died to stop Hitler, millions of innocent civilians across America will die if we do not stop the NRC.

It is time to pay for your dance card, time for the Military/Commercial Fuel Cycle industry to pay their debt to society, to their host communities by keeping their promises, by fulfilling their CONTRACTUAL OBLIGATIONS to remove the waste from these reactor sites NOW, not in the year 2113 as the NRC is attempting to do in this rule change. WE reluctantly signed up and accepted the deaths that have been visited upon our communities in Indian Points first 40 years of operation, we as a community have already PAID OUR PRICE for the Good of the so called Greater Society, and it is time that the NRC keeps its promise made to our community, to all communities who have played host to nuclear reactors here in America...we have paid the price, and now it is time for NRC to make good on their own deliverables by removing (with the DOE) their waste streams that are illegally being stored at these reactor sites.

Moving on to the proposed language in finding number 4 where the new rule would state:

Again, the NRC without ANY TESTING or STUDIES to support their findings is suggesting we have and accept an ever moving target date wherein said wastes can be safely stored at a site. By what rational is the NRC relying upon in claiming wastes can be safely stored on site for these newly extended periods of time that are potentially 60-80 years LONGER than the original data recommended as a safe period of time for onsite storage of these waste streams?

As example, in a illegal and dangerous move, Entergy has been moving spent fuel that is controlled under one license (IP1) onto the site of another licensee (IP2), co-mingling these wastes for a period of time in the spent fuel pool of another licensee, then transferring said spent fuel into Dry Cask storage in casks that have been approved for storage for a period of ONLY 20 YEARS (emphasis added). It therefore seems not only reasonable, but prudent for the NRC to identify the studies they are relying upon in asking for a rule change that would (in the case of Indian Point) move the target date for proper treatment, removal and storage in a licensed facility into the future to the year of at least 2093? Further, seeing as these waste streams by that point in time will have been sitting on the Indian Point site for a period in excess of 120 years, what studies and rational is the NRC relying upon to support their contention in Finding 4 that there is REASONAL ASSURANCE that these waste streams can be safely stored at this and other similar sites for a period of an additional 80 years (60 years beyond the 20 year license renewal period that the NRC has already PRE-DETERMINED WILL BE GRANTED TO ANY LICENSEE WHO ASKS FOR OR SEEKS SAME). If the currently used dry casks are only licensed and approved for storage up to and including 20 years, that would mean either A) the NRC has already decided to blindly rubberstamp a significant (69 years) license extension for these Dry Casks, or B) is envisioning said spent fuel to be moved from Dry Cask to Dry Cask at least four more times between now and when said waste streams would be moved offsite to a LICENSED LONG TERM DISPOSAL FACILITY such as the one that will likely never be built at Yucca Mountain in Nevada. How is the NRC planning on dealing with these additional BURDENS? If these burdens are not going to be born by the licensees, then by whom...include in your answer who will BEAR THE FINANCIAL COSTS.

Either way, one has to ask some questions here:

If Dry Casks now in use have a 20 year life span, and the NRC is asking for a rule change that would push back by 80-100 years the date when they would be required to adequately and safely deal with these waste streams by removing them to a LICENSED LONG TERM DISPOSAL FACILITY

A) What rational and studies are being relied upon in the findings the NRC is making/claiming here? By what rational and relying on what studies has the NRC reached the conclusion and finding that they can safely store these wastes where they sit for over 100 additional years.

B) How can and does the NRC justify their finding that no additional burdens are being placed on their licensee if these changes are implemented when even the most simple of minds can quickly see that dealing with, handling these wastes on site for an additional period of time up to and including 100 years does create some potentially SIGNIFICANT burdens for their licensees, and for the host communities! Dry Casks cost millions of dollars each, and using Indian Point as one example, would see financial obligations/burdens running into the hundreds of millions of dollars if the expected 100 plus Dry Casks envisioned for that site had to be swapped out...further more, what about the additional risks created to both health and the environment as these Cask Swaps create ever increasing amounts of WASTE NEEDING STORAGE, realistically ON SITE?

C) How does the NRC justify their findings, how do they justify their claim of no burdens on their licensees when SEVERAL LICENSEES have already successfully SUED THE DOE for financial compensation for extra burdens they are having to assume because current obligations have not been met by the DOE and the NRC in taking charge and ownership over these waste streams, removing them from the reactor sites as is required under existing laws and agreements? You cannot have a potato, call it a potato in one venue, then go to another venue and claim that potato to be a watermelon. Currently RESOLVED AND SETTLED law suits that deal with this very issue already establish that there are ADDITIONAL OBLIGATIONS AND BURDENS on the licensees when these waste are left where they sit, which by proxy means there are additional (unstudied and unqualified) health and environmental risks and burdens being placed on host communities.

In opposing this rule change, in demanding an end to the dishonest presentations of what has become a ROGUE REGULATORY AGENCY, it is suggested in these comments that we allow the facts as presented in the Federal Registry Announcement to condemn the NRC, to show to all who care to read it the lies that have been perpetuated on the host communities for decades already.

The Five Waste Findings came out of a process begun some 30 years ago in 1979. In 1984 the following findings were created/written into the regulations:

The DOE and NRC's inability to actually site, license and build the Long Term Storage Facility at Yucca Mountain coupled with recent SCIENTIFIC STUDIES that find the site geologically unfit for the long term storage of high radioactive waste streams make the NRC's assertions in finding number 1 FALSE, yet the NRC is proposing to keep this finding as written intact. As a stakeholder, it is therefore requested that the NRC, its assigns, heirs and outside contractors summit too us the stakeholder communities the studies, documents and proof they are relying upon to support finding number one in light of their inability to site, license and build a long term repository for these waste streams at their own preferred site of Yucca Mountain, combined with the reality that even if at some future date uncertain said site is built that its volumes are already spoken for three times over. Giving communities empty assurances is no longer adequate..what solid concrete proof is the NRC offering up to support their claims and contentions in these new findings? What proof can you offer, what guarantees are going to be put on the table to prove you are an agency of your word? We want penalty schedules put in place, want concrete and contractual obligations given to us as host communities, rather than pie in the sky ever changing findings that are ever changing as the NRC again and again fails to meet their own obligations to members of the public in host communities.

In the original finding number two, the NRC represented that ONE OR MORE (emphasis added) long term disposal sites for HWL and SNF WOULD BE AVAILABLE (emphasis added) by the year 2007-2009. For the record, it is noted that these sites (plural) are not ready as promised some 25 years after the NRC made the contractual obligation that they would be. Further, it is pointed out that not only are these sites not ready, they have not even been built, licensed or even formally sited and more importantly there is only one potential site even remotely still in the running at this point in time, and recent scientific studies have deemed Yucca Mountain as unsuited for the purpose.

This past contractual obligation represented in finding two has been dismally failed, yet the NRC is asking us with no studies, no actual proof, no guarantees should (as they will) fail to deliver, allow them to claim they have a Waste Confidence that they can site, build and open for storage a singular site for storage of this ever increasing nuclear waste stream within 100 years of the new finding going into effect...that is simply NOT GOOD ENOUGH, nor can we as host communities and a nation afford the un quantified yet real risks to both human health and the environment when, as surely they will, the NRC and DOE once gain FAIL MISERABLY in their ability to deliver on their FALSE AND MISLEADING UNDOCUMENTED AND UNSTUDIED PROMISES as presented in their proposed changes to findings two and four, and the other findings that would remain intact as currently written. Simply stated, the NRC's confidences ARE WORTHLESS PIECES OF DUNG not worth the paper they are written upon, and should not be tolerated without financial guarantees running into hundreds of billions if not trillions of dollars are put in place to force them to carry out their performance of duties as they present them.

Further, it is noted here for the record, that in its original findings (AND THE CONTRACTUAL OBLIGATIONS MADE AND INCORPORATED INTO THEM WITH THE LANGUAGE USED AND WRITTEN BY NRC STAFF) as codified into the rules in 1984, it was represented by the NRC that within 30 years of expiration of ANY reactor license, they would have the permanent storage capability to accept their wastes. Indian Point 1 was permanently shut down in 1974, and here we are 35 years later and the NRC has not kept its contractual promises to our community, the DOE has not kept its promises to our community, and Entergy has had to taken on additional burdens and legal responsibilities that are entailed in taking care of waste streams that are not and should not still be their legal responsibility for, waste streams that are not supposed to still be sitting on site here in my community. More disturbing, as utility rate payers, we have already PAID THE BILL to have these waste streams safely removed from their current temporary location and moved into permanent LICENSED LONG TERM STORAGE FACILITIES.

Under the newly proposed finding number 2, and presenting no scientific data or studies of merit to back up their contentions and beliefs as represented in said new finding two, the NRC now wants not 30 years, but 100-120 more years to site, license, build and have ready for use a storage facility for the nuclear industry and their life threatening, cancer causing waste streams, all the while wanting to pretend that no additional burdens are created for their licensees, or members of the public in host communities around the nation. The various and numerous law suits brought by NRC's licensees that seek FINANCIAL COMPENSATION for the additional burdens of keeping the waste on site at their facilities make the NRC's presentations negligently, maliciously, egregiously and materially FALSE upon their face. The NRC's callous disregard for the truth, their criminal misrepresentation of basic truths is treasonous, shows them as an agency unfit to continue being the regulators for the most dangerous industry in the history of the world. Furthermore, their own presentations contained within the Federal Registry Announcement on this Rule Change how their finding 2 as previously presented, and as currently presented is invalid and unacceptable and therefore must be rejected as the prefabricated piece of literary fiction that it is. If a gas station has a leaking fuel tank, said station is SHUT DOWN until the leaks are repaired...spent fuel pools are leaking all over America, spewing forth into our ground waters unknown quantities of tritium, strontium 90 and celsium 137, and all the NRC does is promise they will KEEP AND EYE ON IT...these serious environmental damages are being born by our communities because the DOE and the NRC have failed to meet their contractual obligations regarding spent fuel wastes, and it is this reality, this failure on the part of the Federal Government that sees them refusing to properly enforce the rules and regulations meant to protect human health and the environment, sees them ROUTINELY waiving rules that are inconvenient to themselves and their licensees...simply stated, the NRC is no longer regulating their licensees, but instead in collusion with the industry are thwarting the law, ignoring the regulations, and endangering human health and the environment in the name of nuclear profits and proliferation.

Without any justifications for their claims, and ignoring basic truths, in finding number 3 the NRC falsely represents that the waste streams temporarily stored on site at defacto unlicensed and dangerous onsite nuclear dump sites will be done so in a safe manner. A mere glance through the ADAMS site, a quick review on the various and numerous enforcement actions that have been taken against Licensees for improper storage of their waste streams, for violations of 10 CFR rules and regulations as relates to the safe storage of these waste streams (IE, Tritium and Strontium 90 leaks at numerous licensee sites owned by Exelon and Entergy come quickly to mind, not to mention serious violations at Duke and TVA licensed facilities as well), the thousands of generic letters that WAIVE regulations meant too protect host communities show finding number 3 which the NRC wants to keep intact as written to be materially false and misleading upon its face as written. Furthermore, the deteriorating conditions at almost every site of the spent storage fuel pools that have necessitated what could be described as EMERGENCY DRY CASK APPROVAL show that these waste streams are incapable of being safely stored on site at THESE UNLICENSED DEFACTO STORAGE FACILITIES for the 100-120 year period that these rules changes would create.

Looking at the original 1984 finding, comparing it to the proposed finding, one has to ask what studies and scientific studies has the NRC conducted, that they are relying upon in finding number four. The original finding that was reached after a FIVE YEAR PUBLIC PROCESS reached the conclusion that said waste streams could safely be stored where they sit for a period of 30 years or more with NO ACTION NECESSARY...that has born out to be false. In less than 30 years, age, structural decay and break down of the facility that comes with that age have seen spent fuel cracks development of SIGNIFICANT LEAKS as walls threaten to collapse in on the spent fuel racks, which could cause a radioactive Armageddon.

In what can only be described as EMERGENCY ACTIONS, spent fuel was moved into Dry Cask storage in a fatally flawed and abbreviated public participation process...Indian Point is again a good study subject for these claims, and it is pointed out here that the NRC CHOSE TO IGNORE CLAIMS OF CRACKS IN THE PAD meant to hold the Dry Casks at Indian Point because Entergy had reached a CRITICAL POINT OF STORAGE wherein fuel had to be moved into casks, or their reactors shut down due to lack of space in their spent fuel pool for IP2. Overlooked in all of this is the emergency situation that will be created in 20 years when the Casks being used currently ARE NO LONGER LEGALLY USABLE OR LICENSED FOR STORAGE....this fact alone makes the NRC request in their newly proposed findings of a 100-120 year NEW WINDOW OF OPPORTUNITY TO FULFILL OBLIGATIONS CURRENTLY DUE AND PAYABLE TO THE HOST COMMUNITIES UNACCEPTABLE.

As host communities we signed on for a 40 year run, were given assurances and CONTRACTUAL PROMISES that after that 40 year run the waste streams from operation would be removed in a timely fashion not to exceed 60 years. In the case of IP1, that would mean decommissioning the reactor, removing its waste streams and releasing that portion of the site for unrestricted use no later than the year 2034. Simply stated, that deadline is not going to be met, the NRC has wrongfully already waived that obligation for their licensee to the detriment of the host community.

With various tricks and deceits, coupled with this newest ploy as represented in their false findings as presented in their Federal Registry Announcement, they are defacto seeking a change to the rules that would push back their obligations to our community to us as stakeholders to (potentially) 2113, some 70 plus years later than their original promise to our community, to all the other reactor host communities in America....in more frightening, is the very real fact that they are continuing to make FALSE REPRESENTATIONS TO COMMUNITIES as they move forward in attempts to site, license and build a whole new generation of nuclear reactors that will be contributing even larger amounts of waste to this waste stream as they will be far larger reactors than the current reactors that are now in operation.

The NRC wishes to leave 5 as is currently written...it is stated for the record here, that five should be accurately rewritten to represent the truth of the matter as is being experienced by the host communities. Finding 5 should be rewritten as follows:

5. The commission through its past actions and disregard for public health, safety, the environment, and acceptable standards of law has reasonable assurance that we will issue generic findings, disregard rules, and lie to the general public whenever possible in taking whatever steps we deem necessary to protect the financial investments of our licensees, and provide them with whatever onsite storage is necessary to keep their reactors up and operational.

This change to finding 5 is more accurate and truthful, and would represent in true fashion the routine raping of communities that is carried out on the part of the NRC and its staff as they take whatever steps are necessary to preserve an industry that is not worth saving.

It is further noted for the record here, that the NRC's original findings as codified in 1984 said no significant environmental impacts would occur for at least 30 years beyond a facilities expiration of license and/or operation...Indian Point 1 as example ceased operations in 1974, the 30 year window envisioned and studied in the NRC reaching its conclusions has past, as it has for many nuclear facilities throughout the United States. It was not envisioned when those studies were done that the DOD, DOE and NRC would rubberstamp relicensing of every reactor under a stated claim of National Security Interests as has happened, as was orchestrated and allowed under illegal backroom deals made with NEI, the White House, George Bush, his administration, all with the NRC's all too eager wink and nod approval that would preserve their agency, and the tens of thousands of civil service jobs it creates. Setting aside this great racketeering scam perpetrated upon American Society, and looking merely at the original claims and safety benchmark of 30 years of safe onsite storage, it is noted here that the NRC cannot point to ONE SCIENTIFIC STUDY THEY HAVE UNDERTAKEN to justify their new findings, to justify their request to establish what amounts to a new and additional 100-120 year time period for these dangerous waste streams to remain ONSITE AT NUCLEAR REACTORS SITES, defacto forcing host communities to act as UNLICENSED LONG TERM STORAGE FACILTIES FOR THESE WASTE STREAM for at least FIVE GENERATIONS TO COME.

As a part of these comments, it is also formally requested the NRC's Inspector General open a formal investigation into the criminal wrongdoings as are outlined herein, and where appropriate take immediate action to stop the harm being done to the general public in the host communities, and to bring criminal charges against NRC staff for dereliction of duty, and material misrepresentation of facts.

Concept: Next poster in the 'social relationship' series. Looking at the possiblities for the expansion of climate change campaigns 'against coal' into 'against commodity production'. Inspired by the Petroleum Commons and Just Transition, and online debates between red and green. The red colour symbolises the enemy (CO2, the police) with the twist being that the policeman in the poster is actually a miner, taken from the classic photo during the 84 strike. The idea is that by linking things together we won't make enemies of workers and substances and can then target systems and economies (social relationships).
