Guilty and Proud, is the slogan of the Indian Point 11 as they appear in court to plead guilty for blocking the main entrance to the Indian Point Nuclear Power Plant owned by Entergy.

One hour prior to their court appearance, they held a press conference just outside the court house to explain the reasons for their actions and were available afterwards for more comments.

Their message: Over the years, even decades, we have tried many lawful ways to bring to the public and government's attention the needed actions to correct the violations and repeated accidents at this nuclear facility. Indian Point is unsafe, unnneeded AND a major accident and nightmare waiting to happen. Before it's too late: SHUT IT DOWN.

Our only recourse left, is Non-Violent Civil Disobedience and we will continue to do this until our safety and health is firmly secured--Guilty and Proud!

Entergy Shut Down Indian Point

At midnight of 12-12-15, the operating license for Indian Point 3 expired. The license for IP2 expired in 2012. A good crowd came to publicize the danger of these aged and degraded nuclear plants. When the police told them they had to leave, 11 of them did not, were arrested and charged with disorderly conduct. They will proudly plead guilty and explain why they did what they did. Please help pay for legal court costs and come to support them at the courthouse.

Rising From The Ashes...Going to Be Reclaiming This Blog

How sadly tragic that many of the things warned about in this blog have come to fruition as citizens of Japan sit huddled together, alone and scared as they are ordered "Sheltered in Place" as the cancers from the radioactive fallout creeps into their bodies...can we all sing the nuclear industry lie, "There is no immediate danger"...fuck you Indian Point, NEI and NRC...there is danger, and hundreds of thousands of Japanese citizens are already destined to endure horrid cancers, many of them leading to deaths the nuclear industry will deny.

Indian Point needs to close...how many of you know that all three back up diesel generators are housed in the same building on the site? One fire, one flood, and our community is in the same boat Japan now finds itself in, and trust me, the situation there is far worse than the FACE SAVING Japanese officials are letting us know.

This blog was and is my domain, a project breathed into life for a purpose...it is time that I take it back, clean up the garbage from it's bones that does not belong, and refocus it back to it's original intent...a weapon with which to spread the truth about nuclear energy, do wake up the masses.

BUCHANAN, N.Y. (CBSNewYork) – Governor Andrew Cuomo has ordered a complete safety review of Westchester County’s Indian Point nuclear plant after startling new information was revealed by the Nuclear Regulatory Commission.

The NRC reportedly ranked Indian Point as the reactor with the highest risk of earthquake damage in the United States, even higher than the twin reactors in California’s quake zone, reports CBS 2′s Marcia Kramer.

“The Indian Point power plant is the most susceptible to earthquake because reactor number three is on a fault,” Gov. Cuomo said. “Frankly, that was surprising to me. One normally doesn’t think of earthquakes and New York in the same breath.”

Experts say Indian Point is about one mile from the intersection of two faults, and that has the governor concerned.

The plant is just 24 miles from New York City, and according to the NRC, it’s the plant with the highest possibility of earthquake damage.

Cuomo wasted no time in ordering an immediate safety review.

“I’ve had concern about Indian Point for a long time. As attorney general, I did a lot of work on Indian Point,” he said. “My position was that it shouldn’t be relicensed. My position was that it should be closed. I understand the power and the benefit; I also understand the risk, and this plant – in this proximity to New York City – was never a good risk.”

The folks who run Indian Point, however, say they’re not worried about a Japan-like meltdown there.

“I say only if a tsunami could make its way…up New York Harbor and the Hudson River, somehow avoid New York City, and drench our plant,” Jim Streets, director of communications at Entergy Nuclear Northeast, said. “It just doesn’t seem very realistic to me.”

Indian Point’s licenses are up for review in 2013 and 2015. Cuomo’s involvement in the case, and the findings of his safety review, could have an effect on those licenses.

Entergy Is Broke! Long Live Duron!

Entergy is broke, all the tell tale signs are there... The workers at Indian Point are threatening to strike... Entergy is threatening to shut down Vermont Yankee if the Vermont legislature doesn't allow them to operate without sufficient decommissioning funds, because Entergy lost the nest egg playing the market. In turn the state of Vermont is threatening not to issue Entergy a new license because Entergy lied about the extent of a tritium leak which has spread to the Brattleboro water supply... and while all this is going on... Entergy decides to sue the Army Corps of Engineers for $68 million dollars in New Orleans, blaming the Corps for the failure of the levies which flooded their two nuclear power plants during Katrina!

No wonder ConEd decided to sell Indian Point, get itself out from under a jam. Now ConEd can paint itself as a green company, wash their hands of the whole Indian Point debacle, but they're still buying power from Entergy to flow through their grid. So it's still guilt by association!

Now I ask you, what happens if Entergy goes belly up? Who takes over the operation of all their crumbling reactors? And if nobody wants them, why would anyone want a bunch of broken down facilities long past their due date, ready for mothballs, what happens then? Homeland Security steps in? The Navy is the only branch of the Federal Government left which has the man power, the know how and the expertise to tackle such a task. The tax payer is going to flip the bill, or rather, the Bilderbergers keep minting more fresh bills.

We need to get ready not just for the collapse of the cooling tower at Vermont Yankee last year, but the total implosion of the Shaw/Entergy power company, and its consequences on the lives of the residents of reactor hosting communities. It's not about if Entergy keeps operating its reactors, it's about when their operation becomes so obviously, painfully insane do citizens and politicians finally step in to put Entergy out of its misery before another of their regularly scheduled incidents turn into an accident we can't walk away from.

Yes, Haiti... and so many other problems take precedence and seem so timely. But you know what they need most in Haiti right now? Lights! There's a company in India that makes battery solar powered LED lights, for just $130... and a group in Canada which raises money to install them in Haiti, despite so many relief workers getting shot as anarchy rules on the island. Entergy, which everyone in New Orleans keeps called "energy" because they've been trained since childhood to identity the company with power... should have invested in LED companies long ago. Now they probably will need to divest into them, and wouldn't that be a wonderful thing for 2010.

Every American Living Within 25 Miles of A Nuclear Reactor Should File a Pro Se Lawsuit to Build a Nuclear Shelter

For those of us who have the misfortune of living near one of the 104 FAILING NUCLEAR REACTORS in America know two very real facts. 1. The NRC in cahoots with the nuclear industry have been rubber stamping every nuclear reactor license renewal application in the name of saving the industry because of National Interests and Security. 2. Local Nuclear Incident Evacuation Plans will not work, and the NRC has shifted its focus to ordering us to "Shelter in Place" in the case of a significant nuclear incident (terrorist attack, plane accident, or serious breach of containment.)


These two very real realities coupled with the high costs of installing a personal in home Nuclear Shelter have given me much food for thought. It seems very unfair that we as citizens are expected to absorb the $400,000 cost to install and operate our personal shelters, seems unfair we have to take such risks as a cost of having a NRC licensee doing business in our communities. For that reason, I have sent the following letter off to the attorney for Entergy...the licensee for the three reactors in my community. I would strongly suggest that EVERY AMERICAN LIVING WITHIN 25 MILES OF A NUCLEAR REACTOR CONSIDER TAKING SIMILIAR ACTION.

Intent to Sue

For the reasons more fully outlined below, XXXXXXXX hereby formally demands payment for the following costs and damages as are related too the expected license renewal for the NRC licensee sites IP1, IP2, and IP3 and known collectively as Indian Point.

Dear NRC and Entergy:

For the following reasons, I am seeking and demanding legal redress in 1. amount of $400,000 dollars (four hundred thousand dollars) to cover the costs of adequately preparing my property for a potential “Sheltering in Place” incident in my home located at XXXXXXX, Peekskill, NY 10566 should a nuclear incident (terrorist attack or significant accident) occur at the Indian Point site between now and the time the three reactors are eventually decommissioned. This estimated costs that have instituted this demand for payment and notice of my intent to sue are as follows:

A bare bones shelter (http://www.bomb-shelter.net/index.html) (does not include the costs of zoning variances, nor costs of installation is listed for $168,000 and will provide barely adequate space for my wife, I and our six cats for an extended period of time. Estimated legal costs for getting zoning approvals is $25,000. Other necessary upgrades (heating system, fuel tanks, water and waste water storage tanks and their installation has an estimated cost of $80,000. Basic survival supplies to prepare the Shelter have a cost of (as example, the CDC site recommends being prepared to Shelter in place for up to 15 days OR LONGER) $27,000 for a total start up cost of $300,000. The additional $100,000 being sought is the estimated cost of yearly upkeep, maintenance and preparation of the Shelter so that it is always in “Shelter In Place” condition, ready to be used when Entergy or the NRC order us to be sheltered in place during a nuclear incident at Indian Point.

Reasons For This Demand For Payment and Notice of Intent to Sue

1. Citizens in the 25 mile radius of death that is the PEAK FATALITY zone, including both my wife and I had a reasonable expectation that Decommissioning of all three licensed reactors at Indian Point would have commenced no later than 2015, but the NRC’s nationwide rubberstamping of license renewal applications has pushed out the date of potential Decommissioning of these problem plagued reactors at least 20 additional years, and documents found on the NEI, EPRI, NRC and Entergy websites would lead the average citizen to believe the NRC actually plans on granting a second 20 year license extension to this crumbling and decaying set of reactors. When on compares the costs (average out over 40 years), $10,000 a year to protect HUMAN LIFE, to make sure we have an adequate Nuclear Shelter should it be required, this sum is a reasonable demand necessary to cover the costs of keeping my family safe as a direct result of Entergy continuing to do business three scant miles from my home.
2. The NRC in conjunction with FEMA and its licensees has made a charade out of the Federal Guidelines and requirements for a workable Emergency Evacuation Plan. In fact and deed, Entergy Officials and members of the NRC staff have both admitted at public meetings held in the host community that the Indian Point Emergency Evacuation Plan WILL NOT WORK (emphasis added) if there is any kind of a significant event occurring on the Indian Point licensees site(s).
3. Furthermore, the nuclear industry, NEI, EPRI and the NRC have finally admitted in various public forums that “Sheltering in Place” would more than likely be the preferred action to be implemented should a nuclear accident or terrorist attack on a nuclear reactor site occur. This new means of dealing with the safety of the General Public, our families and our pets is a dramatic change that places members of the general public, and specifically my wife and I should a accident or terrorist attack occur at Indian Point in grave danger unless we have adequate access to a certified Nuclear Fall Out Shelter…it is also noted here, that the NRC has only required the licensee to have SPACE TO SHELTER 20 Percent of the citizens in the case of a significant nuclear event at the site.
4. The current suggestions for sheltering in place fail miserably in protecting myself, my wife and our cats. As one example, the NRC staff, the staff of Entergy and the State Emergency Responders have refused to answer a simple question…if there is a significant nuclear event at Indian Point during a significant winter storm, how long would the average citizen have before they started feeling the effects of thermal shock, started seeing hyperthermia set in. Instead of answering the question, they condescendingly suggested we buy with our own funds the necessary supplies and equipment to survive THEIR ACCIDENT should we be ordered to “Shelter in Place” as a result of a serious nuclear incident at the Indian Point facility. Such a suggestion places an unfair FINANCIAL BURDEN on us as citizens, places a demand on us as stakeholders to absorb the costs of Entergy doing business in our community, forces a costs on us as citizens because NRC is unwilling to enforce their rules and regulations in 10CFR, because FEMA has wrongfully signed off on an evacuation plan that is doomed to failure.
5. Since “Sheltering in Place” is now the preferred method of dealing with the citizens should a nuclear incident occur, it is only fair that the costs of being able to SAFELY SHELTER IN PLACE be born by the NRC and it’s licensees. The set up costs for such preparation, having an adequate place in which to survive a nuclear incident at Indian Point without negative impacts to our health, the yearly costs of maintaining such a facility are extensive as has been outlined above. It is only fair that those creating the need for such expenditures pay those expenditures.

For this reason, I am making a demand for payment and giving notice of intent to sue against both Entergy, and the NRC, and am encouraging every citizen in every host community in America to follow suit to file suits as Pro Se litigants in their own local courts. I am further making this demand for payment in preparation of filing suit to protect my rights and health as a citizen of the United States of America. Entergy, the NRC and even the Federal Government have a duty to protect human health and the environment.

This duty takes on special importance in communities across America where citizens are having the NRC force them to play host to dangerous nuclear facilities for an additional twenty years of operation.

A license renewal, continued operation of these facilities places new and unexpected risks on host communities, on citizens living in the peak fatality zone. It is only fair that the NRC and its licensees pay the costs incurred by citizens who seek to adequately prepare themselves for the accident we are constantly told to be ready for…as example, the constant testing of the Emergency Notification System. For these reasons, XXXX hereby makes a demand for the sum of $400,000 to build and maintain a personal Shelter at his residence located at Street in Peekskill, NY. Failure to respond with payment of this Demand in 30 days, failure to open up meaningful dialogue towards settlement will result in further legal action to protect my rights, protect my health, and to assure I have the capability of obeying SAFELY a Federal Governmental Agency order to “Shelter in Place” when the time comes, and trust me, the time will come, if not in my own neighborhood, then in another host community that has wrongfully been forced against their will to play host to a aging, failing nuclear reactor for 20 additional years.

Is NRC Commission About To Pay For DBT Cheating?

NRC Commissioners Under Investigation FOR DBT Fixing

Greetings Anti Nuke Friends...This is an all hands on deck moment, our chance to hand the entire group of Commissioners a serious gut punch for CHEATING when it comes to the DBT. I was (which is not unusual) upset when I learned the Commissioners had once again voted against staff recommendations regarding the strengthening of the DBT (Design Basis Threat) document which dictates what weapons a licensee must be capable of defending against.

I did what I usually do...fired off a scathing ACCUSATION which outlined some of what I know to be a fact, pointing out why I knew the Commissioners were worshipping at the Nuclear Temple of Taint at NEI. Good news...the Inspector Generals Office has informed me that they are going to investigate my allegations, want to set up a time to interview me further on my allegations.

This is where all you in the Anti Nuclear Arena come in, and can become involved. ANYTHING related to REACTOR SECURITY (which if you think about it is ALMOST everything) and the DBT that you want addressed email to me via this email. I am specifically interested in instances where you feel the Commissioners have cheated on the DBT, or have ignored your CONCERNS and ALLEGATIONS regarding the DBT and security issues. IE, force on force exercises. claims that the DBT is inadequate, instances where they have refused to address your concerns regarding the DBT, especially as relates to LICENSE RENEWAL. Think Mothers for Peace, think creating a huge MONSTER PROBLEM for the NRC, think of this as an opportunity to get rid of the likes of Dale Klein.

Hey Richard Barkley....Still Waiting For that DBT Meeting

Some time ago I brought some serious concerns about the DBT to the attention of the NRC. After much delay and excuses, after being told at a public meeting on the record that my concerns would be addressed in a PRIVATE MEETING, I am still waiting. So am curious there Mr. Chairman of the NRC...when do I get to look at the DBT and have my concerns addressed? Meanwhile, from Green Nuclear Underground, a citizens imagination of what could be on the DBT that the NRC is not letting us see...just what RISKS are we facing from terrorists if they Relicense Indian Point. I think we have a right to know, have a right to see the DBT.

Hey NRC...What is in the DBT?

One of the big complaints that host communities have in being forced to host dangerous, failing reactors for another 20 years (besides the fact that they are American Chernoby's waiting to happen) is the fact we are not allow to have any real say in the DBT, nor any idea of what is or is not included in the DBT. Simply stated, we are left to our imaginations. Since the NRC will not honestly let us as Stakeholders know what SECURITY RISKS we face in the event of a terrorist attack, since we do not know what the SLEEPING GUARDS can actually protect against, thought I'd share a few weapons that MIGHT be on the DBT...maybe the NRC will realize truth and open honesty with HOST COMMUNITIES is far less dangerous than our run away imaginations...or not.

KIRTLAND AIR FORCE BASE, N.M., Nov. 1, 2005 – A laser technology being developed by Air Force Research Laboratory employees at Kirtland Air Force Base, N.M., will be the first man-portable, non-lethal deterrrent weapon intended for protecting troops and controlling hostile crowds...Can see Neil Sheehan ordering a couple of dozen!

The weapon, developed by the laboratory's Directed Energy Directorate, employs a two-wavelength laser system and is the first of its kind as a hand-held, single-operator system for troop and perimeter defense.

The laser light used in the weapon temporarily impairs aggressors by illuminating or "dazzling" individuals, removing their ability to see the laser source.

Special Operations Forces Demolition Kit
(SOFDK)

The SOFDK contains a variety of inert items that, when field loaded, provide Special Operations Forces with the capability to tailor charges to the target by using SDK components and C4 or other moldable explosives. The kit provides several methods of attaching charges/munitions to targets. The overall intent is to allow the operator to construct the smallest, lightest charge feasible with the greatest standoff distance attainable and maximum precision. I have a question....how can this type of stuff be put up on EASILY ACCESSIBLE PUBLIC WEB SITES, but we cannot see the DBT? Could it be the NRC does not want Host Communities to know just how PATHETIC Reactor Site Security is?

Each kit will contain explosive, ignition material, attachment devices and a rebar cutter. Hey Richard Barkley, how much of a chance does a CINDER BLOCK SPENT FUEL POOL HAVE AGAINST A RBWK? Is such a kit included in the DBT?

The Reactor Core Breach at Indian Point Three

In a developing news story, our research behind the scenes leads us to pose to Entergy, Indian Point and the Nuclear Regulatory Agency several key questions regarding the long term viability of Indian Point's two functioning reactors, specifically reactor number three.

1. Is it true that in 1984 the NRC and Con Edison hid a breach in the core of reactor three by having their space suited decontamination and repair crews working in the stealth of darkness, bringing crews in and out only under cover of the midnight sky? I'd suggest folks like Neil Sheehan be very careful HOW THEY ANSWER THIS QUESTION...never know what proof might pop up and bite them in the ass.

2. Could Entergy explain why they CHEATED on the reactor core stress test...the MUST PASS test if a nuclear reactor is to win license renewal? Further, can the NRC explain why they are not doing anything about this? Look for an explosive document release to back up this claim in the coming months here on Green Nuclear Butterfly.

3. Can the NRC, Con Edison and Entergy explain why a LARGE GASH in spent fuel pool number two (put there by an errant welder) was NEVER reported, even though it took over a year to repair the leak which was significantly below the water line. (This information comes from a former employee of Underwater Welding out of Connecticut)

4. Can the NRC explain why they have admitted there is tritium leaking on the Indian Point facility that does not match the fingerprint to be coming from the spent fuel pools...isn't it true that the NRC knows emphatically that tritium is LEAKING from the hot leg of both reactor 2 and 3?

Hillary’s ties to Entergy are almost primal. The Little Rock-based Entergy Corporation, which once employed John Huang, the infamous conduit to the Lippo Group, was one of Bill Clinton’s main political sponsors, shoveling more than $100,000 into his campaign’s bank accounts from 1992 to 1996.

Indian Point Reveals Plans To Help Boost Horrid Public Image

What in the world has happened to Riverkeeper? In a recent article, "Indian Point reveals plan for changes, " Entergy promises $100 Million for PR work with local municipalities, tours to increase "buy in" with wary locals, increased emergency facilities to allay resident fears (and better cover their own bee-hinds in the event of a nuclear "incident"), education to replace skiddish nuke workers who, as a rule, don't actually care much for working in leaky, un-safe plants, and making the power plant's elevation and shrubbery look oh-so-purdy!

My word! Riverkeeper's commentary on the way this $100 Mill is being spent simply defies belief! Reportedly, according to the stated quote of Riverkeeper's program director for the Hudson River, "If Entergy wants to pay for this study and wants to spend more money to make improvements on the plant, it's hard to argue with that."

As I see it, even from 170 miles away? It's as easy as pie to argue with the self-serving types of so-called "improvements" Entergy plans on making! Just for starters? It would certainly be a nice gesture if Entergy would use that money instead to make reparations to the millions adversely affected by deadly radioactive contamination of the air, groundwater, Hudson River, and Atlantic Coast for more than four and one-half decades.

Next, while they're at it? Perhaps Entergy could consider putting a few more bucks into trying to stop the leaks under the second radioactive waste fuel pool that have been contaminating both the area's groundwater and the Hudson for an unknown number of years. Now mind you, I'm not saying there's an easy "fix" for this catastrophic enviro-disaster. I'm simply saying that some more money thrown in this direction might be better appreciated in the scheme of our grandchildren's futures than merely spending "improvement" monies on schooling new nuke workers, conducting nuclear plant tours (with accompanying "dosing" for kids on class and scout troop trips), beefing up community emergency response services, slapping on a coat of fresh paint for the building facade, and planting some viburnum and holly bushes to spruce up the grounds!

You see, when a corporation is permitted by the federal government to nuke a community? There are, out of necessity, some quite hefty costs the nukers must be made to pay. So when we're talking about "improvements?" We need instead to be talking about substantial remediation and reparations of such a magnitude that, in the blink of any eye... we've already blown the entire $100 Mill already!

Case in point is the high cost to human health by virtue of living near a nuclear power plant.

Environmental restoration aside, medical bills alone incurred via radioactive poisoning caused by venting and leaking of 3 reactors (and nuclear fuel pools) into the environment over 46 years within the NY-NJ-CT tri-state area are of a truly incalculable magnitude.

I mean, in as far as a nuked-out Hudson and greater NYC metropolitan area, with regard to our precious children who come down with asthma and leukemia, and our friends and family with their autoimmune and neuro-muscular system disorders, breast and pancreatic cancers? Can someone tell me how you even put a dollar amount on such "costs?"

No two ways around it. $100 Million ain't gonna even begun to cut it in terms of the types of "improvements" Entergy's going to have to come up with in order to made good on the damage to public health and environmental degradation and devastation Indian Point owners and operators have been steadily perpetrating since 1962.

Permission to forward to everyone in the greater NYC tri-state area. Certainly, if the local supposed watchdog group for the Hudson is going to applaud this horrid use of $100 Million? This fact needs to be broadcast far and wide as nothing more than the Public Relations boosting stunt it is... a purely CYA effort on the part of Entergy's public image efforts, undoubtedly in need of a pretty major overhaul!

And as far as so-called enviro groups implying these types of "improvements" are a positive thing in terms of the Hudson? Why, this is nothing more than a whitewashing of real "improvements" that are sorely, critically needed with regard to the devastation being caused every day by toxic, radioactive and life-destroying Indian Point routine operations.
